Will I still be able to get my cancer treatments if President Trump uses the Justice Department to invalidate Obamacare?Unfortunately, there is a high likelihood, if the ACA is invalidated, as the US DOJ is now arguing, that you will no longer be able to get your cancer treatments.There are (3) possible outcomes:If you are on an existing insurance plan, you could get canceled, upon renewal, due to your pre-existing condition of cancer; or they could raise your rates to the point where you can't afford coverage.If you apply to a new insurance company, you could either be denied coverage; or be covered with a long waiting period, such as 6 months before you can receive treatment again, and pay much higher premiums, co-pays, deductible, and have annual and lifetime caps.If it is determined that you are uninsurable, you could apply for Medicaid in your state, and then the state rules for eligibility would apply. For example, in IL, typically a person would be required to pay out of pocket for treatment, as a private payor, without insurance, until they had $109,500 left in assets (different rules kick in depending on circumstances), and then they could go on Medicaid and have the cancer treatments covered.Having said all of this, many states have public insurance programs for people who are basically uninsurable; but those options became law when Obamacare became law.It does seem that to all of the states who have created the public option insurance, and rolled out Medicaid expansion, under the ACA, will now have all of those programs invalidated.It is possible that some states will pass laws that continue to offer a public option; so that people do not have to impoverish themselves by the Medicaid spend down requirements.As an aside, if Obamacare is invalidated, you will not be the only person affected. [1][1][1][1] [2][2][2][2] Millions and millions will be negatively impacted. [3][3][3][3]It will strip coverage from at least 20 million people.Kids on the children's health insurance program would lose coverage and low income families would lose coverage.People who purchased insurance on the ACA exchanges (approx 7MM) would lose coverage.It will bring back pre-existing conditions. 52 million non-elderly adults (more than one in four Americans) have pre-existing conditions that would render them uninsurable, or make their healthcare unaffordable.It will bring back even higher premiums, co pays, deductibles, annual & lifetime caps, and unlimited annual rate increases.It will bring back the Medicare donut holes for prescriptions for seniors.It will raise co- pays, deductible, and out of pocket costs for 60MM seniors and disabled on Medicare.Kids who were able to remain on their parents healthcare policies until 26 yrs, will be kicked off.Employers, with over 50 employees will no longer be required to provide an affordable healthcare option for those who work 30 hours from home.Preventive care -- including annual check-ups, mammograms, cholesterol tests and flu shots -- and birth control that were included with policies at no additional cost, will no longer be included.Hospitals would see uncompensated care jump by $50 billion, which would then further increase the costs for people who are privately insured (including employer sponsored insurance ESI).This is not an exhaustive list. This is just part of what happens if Obamacare is invalidated.P.S.
