Property Pool: Fill & Download for Free

My husband and I just purchased our dream home in Sherman Oaks and had a truly remarkable experience with Steve Julian @ John Hart Real Estate. I have bought and sold several properties in Los Angeles over the years and my brother introduced us to Steve Julian who he highly recommended and said he had saved a fortune on his last home purchase. Happily, after an exhaustive search, we finally found our dream home and that's when Steve Julian's service truly kicked in to high gear. We saw the house on a Sunday afternoon and knew it was "the one." We called him from the car and he had the paperwork drawn up for us to sign THAT NIGHT which meant we were able to present our offer to the seller by Monday morning, long before they even had a chance to show the house to realtors on the Tuesday caravan. Our offer was accepted by Wednesday night and by Thursday we were in escrow! Remarkable! And even more incredible, within twenty-four hours, Steve Julian had arranged not only for a general house inspector, but also a geo inspector (it's a hillside property), pool inspector, termite inspector, and chimney inspector. He was physically present at the house with us for the entire six hours of inspections and when the sellers disclosed some maintenance issues involving the house, Steve Julian had an arsenal of specialty contractors for us to contact to get bids so we could properly request credits for repairs. He is also extremely thorough and when we learned of a permit issue with the house, he again came through with a permit facilitator and guided us through the process of going to the L.A. Department of Building and Safety so that we could do our due diligence and truly understand the issues that we were facing. Steve Julian is also an extremely skilled negotiator and at the end of the day, he was able to get us some SIGNIFICANT credits (high five figures). As you can see, we were truly blown away by the entire experience! We were expecting to save some money, but we were delightfully surprised by the extraordinary and personal level of service Steve Julian provided. As I mentioned, I've bought and sold several properties in Los Angeles working with "full service" realtors and none of them ever came close to the kind of personal attention we received from Steve Julian. I’d say you are more likely to sue him and get one of two outcomes:(1) He has to remove the pool, or at least the infringing part.(2) He has to compensate you for your loss by buying that land from you.Now if you agree to access as your compensation, then good on you. But what are the limits and liabilities of this arrangement?What happens if he fails to maintain the pool?How many people from your side are allowed to use the pool? For example, just you? Your family? Your extended family? Guests?What happens when you try to sell your property? Does that mean the next buyer gets the privilege too?What happens if the next buyer doesn’t want a pool on their land?Are you liable for any injuries that occur in the section of the pool that is on your property?Are you responsible for the protective fencing required for the pool?Are you liable if the pool leaks and damages other properties?The point is, I can’t imagine how this is a good solution in the long run.

We have a new neighbor that came in and decided to build a pool. They insist on cutting trees that are on my property, so that they don't accidentally fall in his pool. Am I liable if a tree from my property falls in his pool?You don’t have to cut down a tree because your neighbor is building a pool. Your neighbor just doesn’t want to clean the leaves out of their pool.You would have to be found negligent in some manner by a court for a tree branch falling in his pool for it to be your liability. Tree branches fall all the time. It’s what they all do eventually, usually during high winds or heavy snows.If you are worried about it, talk to your insurance representative about your specific liability for trees falling and your coverage for the same.Your neighbor can cut the portion of the tree that overhangs his property - generally without your permission. Though, if he destroys the tree by doing so, he may be responsible to you for killing your tree. In no way can he legally enter your property to remove your trees without your permission.
