Let me preface this by saying that I have the utmost respect for lawyers.But one thing I noticed, after becoming a police officer, is that many people think that attorneys have more authority and power than they do.Let me explain.Often I would be dispatched to a call from 911, that would result in someone being arrested. This person would inform me they needed to call their attorney. I would normally comply with this request.When they called from home, I would hear the person talking to their lawyer and then put the phone out to me saying "my lawyer wants to talk to you."Now some officers would refuse, saying they didn't have to speak to the attorney. But I always thought I'd be polite and took the phone to converse with the attorney.It quickly became apparent to me,that the arrestee was expecting his lawyer to "order" me to do something different than what I'd planned regarding my arrest.The conversation usually went like this.Me: "This is Ofc. Mitchell"Them: "Hi Ofc. Mitchell, how are you?So what will you be doing regarding (fill in the blank)?"Me: "I will be taking him to jail and booking him in on (fill in the blank) charge." (Or whatever applied)Them: "Okay then. Will you tell my client that....1. I will talk to him tomorrow before court?Or2. He/she can call me after you book him in?"Me: "Sure."Them: "Thanks Ofc. Mitchell. Goodnight"Me: "Goodnight"I hang up and my arrest is looking at me smugly.He believes his lawyer "set me straight" and I have been properly admonished and will now uncuff him.Imagine his surprise when I said "your lawyer says to call him after booking or he will see you tomorrow before you go before a judge."My point is, lawyers are extremely important in the criminal justice and court system. And anyone who doesn't use one when facing charges is foolish. But they do not have the right, nor would they assume, to instruct the police on how to do their job.Their job starts after the arrest. Not during it.In the order of people with "power" per se.3. Police. They can take away your freedom immediately. Even if the charges are weak and would never stick, you still go to jail and the officer books you on as many offenses as they choose. Scary if you have an unscrupulous cop you are dealing with!2. County/city prosecutors or similar. This person decides if the charges against you will hold up in court and can add or take away charges as they see fit. They can have you set free immediately, if they think what you were charged with won't fly in court. They can get you out of jail.1. JudgesThese people have the ultimate authority. They can overrule the police and the prosecutors.If they feel the the elements of the crime, that are necessary to charge someone, were not met to warrant an arrest, the charges can be dropped.They can refuse to issue search warrants brought by the police. And while they normally don't, they can overrule anybody.Judges have enormous discretion. In sentencing particularly, they can have almost identical criminal cases before them, yet hand out rulings that are 180 degrees different from each other.So where do lawyers fit in all this?In an important place.They are legal EXPERTS!Let me say that again.Lawyers are necessary experts.Anybody who goes to court not being represented by an attorney, court appointed or hired privately, is just asking for a conviction.Attorneys know all the ins and outs of the court system and are worth their weight in gold.But their "power" comes in their knowledge and experience in their chosen field.

Well, I wouldn’t express it that way.What you are really doing if you sign a piece of paper and tell someone else to “fill in the details” is that you are basically authorising them as your agent to complete the agreement on your behalf. And if you are going to do that, you don’t really need to bother to sign it at all - you just sign an appropriate power of attorney to give them agency to enter into the agreement on your behalf.Much cleaner and more orthodox.
