Why is child marriage still legal in some states?“Child marriage” technically means anyone under 18 or 21 years of age, depending on how you define “child”.In EVERY US state, the age of consent (meaning marriage without third party permission) is at least 18. It’s 19 in Nebraska, and 21 in Mississippi and Puerto Rico.However, most states also have exceptions to allow under-age marriage with court approval. The reason for allowing marriages under the age of 18 is because teenagers get pregnant. Most parents and states would prefer their daughters not be unwed mothers. By allowing underage marriage with parental consent at 16, it enables families to “save face” about what their children have been up to. Marriages younger than that always require a judge’s consent. That’s to prevent children (usually girls) being married off to older men. In a study done in Nevada, nearly every marriage license application that involved an underage (meaning under 16) marriage, the child was overwhelmingly female.
