My attorney advises that I stay in town for court because there is a very good chance of getting him back. If I would be awarded custody she wanted me present for the judge (hearing was January 6th).We attend to our hearing. All of us anticipating the case be dropped at the request of the guardian ad litem due to lack of cooperation from the father. Prior to court, the attorneys and the GAL meet with the judge in his chambers to discuss the case.Judge and everyone comes out, court begins. The motion was made for the motion to be dismissed. My ex was arrested for selling heroin to an undercover TWICE! He was held on a probation violation. Therefore, no bail was permitted. All while in jail he’s not dropping our case. The GAL tells me in America we are all innocent until proven guilty. He has only been arrested and has had not been tried. We managed to get his attorney talk him into signing our agreement pending his rights across the board. If he wanted any of them back he then would have to file a motion with the courts in NC.
