The answers depends on the state and the type of power of attorney (POA).First off I have had powers of attorney IGNORED for decades. Some states, Texas in this case, have finally put in some protections to give a power of attorney more teeth. In the past institutions could insist the power of attorney be altered to their own particular form or format and they could ignore as they wished. The law which took affect September 1, 2014 is based specifically on the Texas Statutory Power of Attorney. It is my understanding if you did not use that specific form, you may not have the protections.The protections are that the party to who the POA is presented can no longer insist on a new/different power of attorney IF you used the statutory POA. The party to whom you are presenting the POA can question the validity of the POA and you must respond within 10 day (I believe - from memory). The other party can insist to verify the party that issued the POA is still alive - because all POAs die along with the person that issued the authority. There is still no requirement to do business with the party with the POA IF it is new business. If it is existing business and the validity of the POA is not quesstion or verified and the authorizing party is alive, then the POA must be honored.These protections exist in some states but not others.POAs typically come in two types. There is the type where authority is immediately granted (usually called a durable power of attorney) and another called a “springing power of attorney” where the authority springs into power upon a specific date, event or occurrence. All POAs die along with the party that issued the authority.The most common areas where POAs are given are for financial or medical purposes. It is common to combine them into one and give all power to one person, but also common to separate financial powers of attorney from medical powers of attorney.Lastly a power of attorney can be revoked by the issuing party at any time. With this in mind, in reference to your question there is nothing to stop the original borrower from doing as they please. They can certainly borrow on the credit line if the bank deems them still credit worthy.
