Every person, not just elderly people, should have a Living Will and Health Care Power of Attorney.In Ohio, those documents are standard and are available on the internet. Never pay an attorney to prepare those documents.It is also important to have a Will and possibly a Power of Attorney. A Trust might also be valuable. All those documents require an attorney.It is vitally important to have those documents finalized prior to the time a person loses competence.

I came across one common scam involving these so-called “home health aids”-people the elderly or disabled people hire to look out for them. I work in retail grocery and some of them do the most sickening scams to their own clients. Some will fork over their credit cards to do shopping for them, but they sit there buying shit for themselves using their client’s cards. I caught at least 7–8 of these so-called home health aids doing already.What they would do is come into the store and try buying stuff without their client’s knowledge that they have the card, ring up their grocery items, and then try using credit with the bank issued debit card. The grocery store I was at at the time required you to have an ID with all credit card transactions-otherwise they were forced to do debit and know the pin number to the card. If they didn’t know the pin, this is how we knew the card was taken without that persons knowledge. We did give them the opportunity to call the card holder and get the pin first, but if they refused to call the cardholder to get the pin, this is when we definately knew the card was being used illegally.A few of these home health aids we caught would try to lie that they had power of attorney on their clients. Problem is, I knew they were lying. In the State of Ohio, unless all of the relatives of the patient are dead, the only way someone can get power of attorney on someone is if they are next of kin. Once that is established, you must take the proper documentation to the banks and have your name added to the account. Once that is done, the banks will reissue any bank cards or checks with BOTH the power of attorney person’s name and the original account holder’s name on it. They don’t give no power of attorney to no home health aide. When they would show up trying to shop, that second name wouldn’t be either on the check or the credit card at all. The ones who stole the card would try to use the power of attorney lie and we would have to insist with them to do debit so we won’t be liable for the fraudulent transaction and the ones who refused would leave the groceries-this is how we knew that they were lying. One lady we stopped trying to run the scam was eventually caught when she made off with over $500,000 worth of her client’s money doing what she was trying to do in my line by using her credit card that was stolen. The elderly woman lived out in a wealthy suburb and this home health aid would spend hundreds of dollars trying to get this elderly lady to pay for her food and for expensive purses. Thank God when this lady than came into the store that day, I refused to do it as credit because I knew she didn’t obtain the card legally. Literally two days later, the police arrested her for using the same stolen card she tried to use with me at another store. They were watching her for some time too. They even followed her into the store with her and they were trailing her.Now, there are some elderly and disabled who absolutely have nobody to care for them and they check into an assisted living facility that do have home health aides working for them. Now if the state cannot find someone to care for them, they will give the power of attorney to the company and our store as well as other retailers force these type of companies that provide these services to file the paperwork at the service desk that they are caring for someone and that they do in fact have power of attorney on them. The store will verify the paperwork which takes about two weeks and then they will have these companies get a corporate credit card with them to pay for the client’s food, medicines, personal hygiene products, etc., so they could monitor the fraud and to protect the elderly clients from losing money.

Moving from one state in the USA to another does not require much research. Generally people find out about these things over time, on an as-needed basis.It is a nuisance, but usually only minor.You need to get a new driver’s license and license plates; rules for things such as required car inspection vary across states. Where you go and what you need to do may differ - it used to be town hall or the department of motor vehicles, now this can usually be done on line. Usually there is a grace period of at least a few months.Norms for driving and for queuing differ. In some states drivers give people a chance to find an opening when they try to enter the highway; in other states, they studiously avoid eye contact and speed up. In Oregon they expect you to leave an airplane politely, by row. In Boston, people just go.You need to register to vote in your new home town.Some state drivers’ licenses meet the standards for identification for airline travel - others do not. I believe enforcement begins Jan. 2018.Cost and requirements for auto insurance may differ. As soon as you contact an insurance agent, you get this information.Available health insurance plans are likely to be different.You need to be aware of tax differences. Some states have high rates of sales tax and others have none. You find this out the first time you buy things. Some states have taxes on income and/or dividends; you may find out about this the first time you file tax returns. Estate taxes can differ.If you are in a profession that requires licensing or certification, such as psychotherapist, you may need to meet new requirements (some states have reciprocity agreements, but not all).If you have forms such as a will, power of attorney, or designated health care power of attorney, it’s a good idea to have a lawyer in the new state rewrite them. I forget the exact term, but I had to have my late father’s will somehow certified by the state where he made the will before I could execute it in the state where he died.Laws about medical assistance in dying differ across states. I received a letter from the last town I lived in telling me I was allowed to keep a goat and up to three chickens on my property… it was a fairly high density residential neighborhood. Most similar towns would not permit that.The minimum age to drink alcohol is now 21 in all states, but prior to 1984, states set their own age limits. It was age 21 in PA where I grew up, and age 18 5 miles away across the Ohio state line.Having different laws for so many things in different states creates a lot of business for attorneys!Cultural/ language differences tend to be minor. So called “blue laws” in some states restrict retail sales (particularly alcohol) on Sundays.There are differences in slang and pronunciation. What we in New England call soda is called “pop” or generically “coke” (even if it is not Coca Cola) in other parts of the country.I don’t know if this is still the case, but when I moved to Boston as a student, I learned that, when they asked “Do you want your coffee regular?” it meant black coffee.It is nothing like the cultural differences when crossing borders in Europe, but there are differences, particularly for states that are far apart.
