Lien Waiver Georgia: Fill & Download for Free

This is not especially lurid or exciting but really bothers me. A contractor had its subcontractors sign an agreement providing for payment after 75 days had passed. That is quite a long time to wait.The timing was very calculated. Under Georgia law, if a subcontractor or materialman signs a lien release, the amount paid under the release is presumed to have been received unless the claimant takes some kind of formal action to preserve its rights to secure its claim by filing a lien or bond claim.So the contractor required all these folks to sign this waiver in order to apply for payment. Then the waiver became effective after 60 days, even though the contractor could claim that the payment was not even past due (because the 75 days had not run).Pretty manipulative and dirty. Should the court allow that and enforce the release? Probably not.
