How hard was GDPR compliance for European web companies?As of May 25, 2018, companies, and especially European web companies need to comply with the GDPR directive. If they are non-compliant, they may face heavy fines.It definitely cost effort in order to comply when you collect and process Personal Data of EU netizens. This Personal Data includes Name, address, email address, phone number and anything else which a person can be identified from.Check out this GDPR complete compliance checklist:Step I: Create a lawful basis and ensure transparency:Conduct an information audit to determine what information you process and who has access to it.Have a legal justification for your data processing activities.Provide clear information about your data processing and legal justification in your privacy policyStep II: Ensure data protection by design and by default:Data protection has to be taken into account at all times. When developing a new product or service and every-time you are processing data.Make sure to encrypt, anonymize and pseudonymize personal wherever possible.Setup an internal security policy and ensure your employee are aware.Understand when to conduct a data protection (DP) assessment, and have the process set up so you can carry it out instantly.Ensure that you have a procedure in place regarding what to do and whom to contact in the event of a data breach. Make sure you know which authorities to contact when.Step III: Governance & accountability:Make one of your employee responsible for ensuring compliance across your organization.Make sure data processing agreements have been signed with any third parties that process personal data on your companies behalf.If your company is outside the EU: appoint a representative within the EU.Appoint a DPO (Data Protection Officer) when necessary.Step IV: EU citizen privacy rights:Ensure it is easy for your customers to request and receive all the information that you have on them.Make it easy for your customer to correct and update inaccurate or incomplete information.EU citizen should be able to file a personal data deletion request.EU Customers need to be able to stop you form processing their personal data.Ensure there is a process in place that enables EU citizen to receive a copy of all their personal data if a format that can be easily read and processed. However, it seems there are not many GDPR compliance certification officers yet. If they are there, they are scarce and often expensive. It’s important to start doing the procedure yourself and appoint a Data Protection Officer (DPO).…so why is it important to comply?Since it’s the intention of the GDPR to protect the personal data of EU citizens wherever it is held; there are strict requirements governing where personal data can be transferred to and the measures that must be in place for such as transfer to be legal. When millions of internet users globally go to look up…lets say information regarding dog breeds, more likely than not they’ll go to utilize top search engines such as Google, Yahoo, Bing, etc. Creating a decentralized engine that is controlled, maintained, and driven by the community sounds good at least on paper. The main challenge is overcoming the challenges that many cryptocurrencies face today, which include, but are not limited to:Mainstream adoptionAwarenessEase of useWith those in mind, (and reading various sections on their website Presearch) it seems evident that this is a project that I feel holds potential to be viable in the next 5 years.The second question I’d ask myself is: Does it provide a use in society?I believe this coin holds a use in society today as it’s a token-based system for a decentralized search engine. It’s arguable that Google holds the biggest stake in search engines, which allows them to control more than what we possibly know right now. In fact, Google only recently was the subject of a $2.7 billion dollar EU Anti-Trust case (Google Fined Record $2.7 Billion in E.U. Antitrust Ruling). This kind of coin has its place in a society where privacy and shady behind-the-scenes deals are coming to light more and more.The third and last question I’d ask myself is Is there active development currently in place?Looking into the website, it seems pretty evident that there is active development on the project. Do not believe in anybody who says that some certification is essential/required/needed/worthy towards GDPR. They are only trying to squeeze money out of you.I’ve been studying GDPR since its inception in 2014 and I’ve been working (as DPO data protection officer and otherwise) for a few customers of mine. I was also, unfortunately, involved in a data breach case and I’ve heard from a national data privacy supervisory authority and worked with them.GDPR is explicitly not about a checklist of things to be done. The best thing you can do is taking a day and reading it all — it’s available in a dozen languages — then googling the details you find interesting in your case and you are uncertain you’ve understood.In a nutshell GDPR requires your company to study its own specific way of doing IT, question its methods and procedures, enhance them privacy-wise and grant users (at least users living in EU, but hopefully everyone) some specific rights. Nobody can do that but you. An external consultant might be of help.
