PDF Editor FAQ

What is the best and easy way in Canada to get my PR after my asylum application is rejected while living in Quebec?

If your asylum application is rejected, you are not admissible to Canada for any reason for a minimum period of five years, and more likely longer. In any event, you cannot apply for permanent residence in Canada while you are resident in Canada. The only way to apply for permanent residence is while you are outside Canada. If you have immigration counsel, they should have explained to you that you cannot pursue an asylum or refugee application together with a permanent residency application. In most cases, if you are not legally resident in Canada, it is far better to return to your country and apply for PR than to enter Canada illegally and apply for asylum.

I am in Canada on study permit but just found out that as gay I can seek refugee status in Canada, what step should I take to change status to PR?

I’m not sure why that would be beneficial in your position. Refugee status will make your life much more difficult because you will need to surrender your passport and enter the refugee system. To be found a bond fide refugee you would need to be able to demonstrate a personal grounded basis for your claims. Many refugee applications from people who actually are likely to die if they must return home are denied. As a student, you will be eligible for a post graduate work permit when you graduate. After working for a year in a qualified occupation you would be eligible to apply for permanent residency via Express entry. Odds are, you would have PR faster, with far less complication, than if you filed a refugee claim now. Refugee applications take years to process. You won’t be able to leave Canada (remember, you surrender your passport as part of your claim) and you won’t gain anything useful from a PR perspective. If you cannot demonstrate a grounded, personal fear of persecution at home, your Refugee application will be refused and at that point it is unlikely you will be able to stay in Canada as a student (if you haven’t finished). IRCC would likely refuse a post graduate work permit because they would reasonably conclude you won’t leave at the end of the work permit. In your situation, you should speak with an experienced immigration lawyer (NOT a consultant) before submitting a refugee claim.Several others assumed you are lying. If you cannot clearly demonstrate that you are in fact gay, it would be very unwise to file a refugee claim based upon your sexual orientation, since if that is the basis for your fear of persecution, then not being able to demonstrate it could lead to a quick decision and execution of a removal order against you. Again, it would be best to speak with an attorney familiar with the issues and the standards of evidence required. They won’t help you commit fraud, but they can honestly assess your situation and provide you with better advice than any non-attorney on Quora.

Have you successfully immigrated to Canada?

Yes, i have successfully immigrated to Canada before 1 year in September 2017.I have taken Ontario PNP applied in February 2016 and i received PNP in December 2016. It was a late processing since it was paper based Application and at that time IRCC was giving priority to Refugee Applications due to Refugee Crisis in Syria. Received ITA in December itself and Submitted Application to IRCC in February 2016.Finally, in June 2017, the long awaited Day came and received the mail from IRCC to submit the Passport and landed in September 2017 in the land where now everyone wants to live.Sometime immigration process become lengthy and time consuming so i would say patience is the key and when your receive the mail from IRCC in your express entry profile to submit Passport to VFS on that day, all your wait becomes nothing in front of the joy you will get seeing that mail.Hope this helps. All the best.
