I’m a lawyer and not a doctor. This question points out the hypocrisy existing between how society treats lawyers vs doctors.From the Doctor’s stand point, I’m sure there are plenty of doctors who use or provide their skills to the under privileged. Doctors without Borders in the most recognized example, but I’m sure there are plenty of other ways doctors treat people without an expectation of payment.Lawyers on the other hand are encouraged to take pro-bono cases as a part of their normal practice. Study after study reports that the societal benefits of providing competent legal representation to persons of meager means or the poor are multi-fold.So where is the hypocrisy? Lawyers have a built in constitutional amendment, the 6th amendment, that ensures that a practicing lawyer, who is willing to do certain kind of work, can find clients. Criminal lawyers sometimes joke, that the only in criminal work will the state gather all of your prospective clients in one place (jail) and hold them for you, free of charge. Still while its a constitutional requirement to have a lawyer appointed to your case, that doesn’t necessarily mean that the state has to pay the lawyer or has to pay the lawyer at or close to his or her normal rate. Tennessee on July 1 raised the rate from $40.00 to $50.00. This is the first raise since 1994, yes nearly 24 years since appointed attorneys have seen a pay raise. Believe me, lawyers are not chomping at the bit to take appointed case work at a fraction of their normal hourly rate.Doctors on the other hand have two important programs that ensure they receive payment for their services. The ACA required (past tense) insurance, which surely benefits health care and by extension doctors, and when you reach 65 medicare ensures the doctor will receive some sort of payment, and I’m sure its not a fraction (1/3, 1/4 or 1/8) their normal rate. There are three instances where you should or could appoint someone to be your power of attorney.Special Power of Attorney or Limited Power of Attorney. It’s used typically with the elderly and is put into place to allow someone to pay bills and keep track of their affairs on a more or less permanent basis. The grantor retains the ability to overrule the attorney in fact.Health Care Power of Attorney — Living Will. In my state (Tennessee) a separate document is required when the grantor gives someone the ability to make health care decisions.
