Even if you don’t have a religion, even if you were born outside India, as long as you believe in the concept of India, you are Indian. India is neither Pakistan nor Israel to believe in the country of any religious group. Hindus of Pakistan or Bangladesh are not Indians in any manner, as they are primarily Pakistanis or Bangladeshis. So as Sri Lankan Tamils are primarily Sri Lankans, not Indians. They are welcome to India to become an Indian if due process of naturalization is followed. But that due process must be common for all. A Pakistani Muslim and Pakistani Hindu who runs away from their state out of fear of life must be treated in same way in India as both are Pakistanis. We cannot pull their trousers down and determine the right of naturalization. The underlying principle for any refugee nationalization should be HUMANITY, not religion (ofcourse- state security is equally important, but state security must not be viewed in the religious prism). If you call a refugee who runs away from his/her homeland to another country out of fear of his/her life as a termite, there can’t difference between Hindu termite and Muslim Termite.So a larger percentage of us (atleast those Malayalees whom I know and understands thro’ media) rejects the idea of the differentiated rule of naturalization based on religion and we understand the larger motives.We Malayalees joined the Union of India in 1949 out of our genuine passion and interest to be part of a multi-cultural diverse society with a common identity of being Indians. Our former identities, ie Travancore and Kochi (even older Malabar Kingdoms) were Hindu Kingdoms ruled in name of the Hindu deities. We collectively decided we don’t need to remain in such identity and moved to a secular identity of India. In a way, it was a collective decision of our forefathers to move out from then-the Hindu Rashtras of Travancore and Cochin. Our forefathers fought against Travancore which declared Independence from India in 1946. Travancore wanted to establish a Hindu Independent Kingdom where Lord Vishnu would be the constitutional sovereign of the state. We threw that constitution into the Arabian sea and embraced India for its secular identity. Now, don’t tell us to accept Nagpur’s diktats and Manusmriti ideals as our new constitutional values. If so, isn’t it far better to revive that Old Travancore Constitution? Atleast its in Malayalam, rather than being part of Hindi Aryavrat!!!So in no way, we can accept the sinister motives of CAB and upcoming NRC which are the first steps to establish a Hindu Rashtra. If so, the Indian Union should be expecting something that happened to USSR in 1991.The Government of Kerala has reaffirmed once again, by no means and way, CAB and NRC will be allowed in Kerala. This has been reconfirmed by Chief Minister of Kerala- Pinarayi Vijayan after a special cabinet meeting todayKerala refuses to implement CAB, joins Punjab, BengalOfcourse, legally its not possible, because Kerala is just a state of Republic of India and no way, it can legally avoid legislation passed by Government of India.But Kerala government, like any government, can be at choice to adhere or not adhere. Unless the government machinery adheres to law, no laws can be implemented. For example, CPM at the national level is opposed to UAPA law and often says its draconian. But in Kerala, Chief Minister Pinarayi Vijayan, even though a member of Polit Bureau of CPM, differs much on it. He believes a law like UAPA is very much needed against enemies of the state, particularly Naxals quite contrary to his party’s position. And as he is the Home Minister too, he has given an upper hand to State Police to implement UAPA and arrest every Pro-Naxal elements in the state, which recently includes 2 young members of his own party. Despite of his party’s opposition, he was able to convince them, its important for state security and must move ahead with it.What if, Pinarayi Vijayan like all other typical CPM leaders, don’t believe in UAPA? It won’t be charged at the very first place and instructions would be given to police never to adhere to that law. There are 100s of Laws that Kerala don’t adhere much, even though it exists as a National law. For example, the Govt of India brought RERA ACT (Real estate Regulation Act 2016), but even today its a non-starter in Kerala (almost after 3 years). In the paper, there is a regulator in Kerala, but hardly any powers or authority as no rules or relegation of powers ever made. So the national act is unenforceable in Kerala (I want that law to be enforced in Kerala, by the way).So what can Govt of India do? Can they bring officials from Delhi and manage Kerala RERA?The same thing associated with CAB and NRC.I am not sure, how they say, they will not implement CAB as Citizenship doesn’t fall under the state government’s scope of governance unlike RERA/UAPA cases as I mentioned above.But I guess, its more of a political statement, to reaffirm the official stand of Kerala Govt. Kerala society in the majority (barring a small section of Pro-BJP elements) are opposed to the concept of CAB. All political parties in the state sense that mood. If I believe, even BJP Kerala unit also senses that mood well as they are taking extra care not to make any sort of statements on this matter. I was so surprised to see how moderately even this discussion happened in their own Malayalam news channel- Janam TV which is always known for typical RSS styled aggressive rhetorics. No major leader of the BJP unit in Kerala has made any aggressive statement so far, which alone proves they too realize the mood of the public. So barring some extreme Islamophobic Sanghi fanatics of some fringe groups, even RWs in Kerala aren’t talking much on CAB.Anyways, CAB is not something serious in Kerala as we don’t have any case of people of those 3 countries (Bangladesh, Pakistan and Afghanistan) living here as refugees. Kerala society as such always takes note of non-Malayalees living inside Kerala and its not that easy for outsiders (barring south Indians like Tamilians or Tulu or similar) to quickly assimilate into Kerala society. So unlike Assam, we don’t have issues/fears of Bengalis taking over Kerala society or its culture as they aren’t able to assimilate into Kerala culture and always seen as outsiders, thus effectively reducing chances altering demographics. And again, even with massive dependence on so-called Bengali workers for all kinds of low-strata jobs, they are not that high in number unlike neighbouring Karnataka etc. So CAB as such is not worrisome for Kerala.But Malayalee community sees CAB as a sinister motive to be used when NRC being rolled out by Central Govt. That time, those existing Indian citizens, if unable to submit the so-called documents of citizens as mandated by Central Govt, may be stripped of their citizenship. It's in such circumstances CAB as such works into play.Though CAB as such doesn’t have much role for Kerala govt to play in, NRC will definitely have.NRC, to be rolled out, needs state government and its machinery support. Even if Central Govt dismisses the current state government and has President rule’s to implement NRC as per its whims and fancies, the state machinery will not cooperate. What I understand is that all Employees unions associated with both UDF and LDF are planning to have a common understanding to boycott any NRC process in Kerala. Some online news reports are even suggestion State Police Association (informal union of non-IPS officials of Kerala Police) are too mooting such plans of disassociating with any NRC process. In short, it simply means MASS CIVIL DISOBEDIENCE as done in the British Era.So the current declaration of Kerala CM is a strong message to entire employees, there is a strong political will in the state to boycott or resist any action of NRC in the state aimed to polarize Indian society.So as Kerala Govt already hinted that they will file a case in Supreme court against CAB, once it becomes a law. That is also a powerful symbolic action when a state govt itself making a petition before Court to nullify the action of Central Govt.I guess, that's all, a State Government can do in this matter.
