As one of the governor’s attorneys wrote in a brief to the U.S. Court of Appeals:[1]Her local policy stood in direct conflict with her statutory obligation to issue marriage licenses to qualified Kentucky couples. The local policy also undermined the Commonwealth of Kentucky’s interest in upholding the rule of law.Davis put her personal religious beliefs above the law and above the interest of citizens she had sworn to serve. She did not have the right to deny marriage licenses to the plaintiffs after the U.S. Supreme Court recognized the constitutional right of same-sex couples to marry.Your second question is not entirely accurate. Non-governmental attorneys representing Governor Matt Bevin argue in court that Davis herself should pay the attorney fees, but Bevin himself today reiterated his personal support for Davis.
