Why is it so difficult to get a German driving license?

Theory exam:Theory exam consists of 30 multiple choice, multiple answer questions. So, there can be at least one or more or all choices possible. Wrong/insufficient answers score minus/null points. Passing score is 100 out of total 110. This makes theory exam more tricky! You need to practice the questions a lot and sometimes mug up the answers. There are some publications which provide possible 1000+ Questions & Ans.Now just take an example question from theory exam below:This traffic sign indicates -Chances of a cow on the roadChances of a dog on the roadNo parkingChances of dirt on the roadAnswer:As most of you guessed - choice 1 is correct, no doubt about that (?) But did you guess choices “2” & “4”? The correct choices are: 1,2, and 4. Dogs (and other farmyard pets) along with Cows can be understood. But, why “4” is also correct? The official explanation says - maybe the cow sh#tted on the road (cow-dung) or, cow didn’t wash her feet before crossing the road (mud). They (cow-dung and mud) together may increase the braking distance significantly.I am not kidding, I really failed that question.If you are interested then you can try the theory exams here: Test1 or Test2Practical exam:It consists of full 45 minutes of driving with your instructor (in co-driver seat) and an inspector/examiner (across seat in the back). The instructor is there just to press the brakes in case of emergency and not for a help. A buzzer goes off, if instructor touches any of the pedals (fail!). Rest of the time, he will chit-chat with inspector. Never ever take part in that interesting conversation (fail!).The inspector is closely observing you during 45 min. test. A small mistake and game over! On exam day, a girl opted to take exam first, so I ordered a coffee. They hardly went for 5 min. and came back - before my coffee was ready. My instructor told me later on, that she was nervous and jumped on the first traffic light which just turned red and game over.During the test, he will ask you to drive on busy roads in city, one ways, motorways (Autobahn), side parking, reversing, right before left crossings, and all kinds of yoga. He will keenly observe you (while talking to instructor) whether you read all the road-signs correctly and not miss (or mess) any (I wished I had 8 eyes like a spider and 8 limbs like an octopus!)The most tricky part for me was side-parking. It’s not that I could not park sideways. But after I parked, he just asked me one question - “have you parked correctly?”. I know this Q from my instructor and answer too. I confidently said “Yes”. If you say “No”, then he will ask you to correct until you finally say “Yes”. Then, he will check whether you look out of the window (by turning head, not just checking mirrors and side-indicator ON) before you take the car out of the parking lot (checking blind spots).Well I did pass both the exams in first attempt, especially the driving exam coincidentally on 1st April. I confirmed with the inspector directly whether he was not (April) fooling around ;) He signed and gave me the driving license on the spot after the practical exam. Then I was on cloud 9. But that needed dedicated practice for both theory and practical exams. Don’t underestimate them.It’s not over after you get a driving license. You will be in two years of probation period. If you commit some serious offense, then your driving license will be suspended and you need to repeat the course again. After successful two years of driving, if you commit some serious offense, then the driving license can be suspended for at least 6 months (point based system) and sometimes you need to repeat the course, and/or to take medical-psychological examination (especially for drug/drunk-driving).Here is the list of penalties for various offenses.The following video shows how the practical exam is conducted in short:Expenses:German driving test is not only challenging but expensive as well. Are kids under 12 able to commit a crime?

There is a famous case everyone learns in law school, and the name escapes me, but the facts were that a full-figured lady was going to sit down in a chair. A 5–year-old pulled the chair away, thinking it would be funny like a cartoon. It wasn’t; she was injured and sued. The issue was whether a child that age could reasonably be expected to foresee the injury. The Court held the child was too young to have formed the requisite careless intent.The fact that history repeats itself was shown in the 2016 case in Nielsen ex rel. C.N. v. Bell ex rel. B.B. Supreme Court of Utah. March 24, 2016 370 P.3d 925 2016 WL 1178392 in which a 5-year-old threw a toy at a babysitter, struck her in the eye, and left her with impaired sight. She sued for damages. The Court held that “Although this court has never held that children under seven may not be held liable for negligence, we have recognized that there is an age at which a child is “so young and immature as to require the court to judicially know that he is not responsible for his act.” Donohue v. Rolando, 16 Utah 2d 294, 400 P.2d 12, 14 (1965). But we have not yet explicitly held what the cutoff age for negligence liability is. This court has previously decided this question on an ad hoc basis. An examination of our caselaw, though, reveals a dividing line between children under the age of five and children aged five and above.¶ 15 As noted above, when we have examined the capacity of five and six year olds to be negligent we have held that it was a jury question unless reasonable minds could not differ on the issue. Donohue, 400 P.2d at 13–14; *928Rivas v. Pac. Fin. Co., 16 Utah 2d 183, 397 P.2d 990, 991–92 (1964); Mann v. Fairbourn, 12 Utah 2d 342, 366 P.2d 603, 604, 606 (1961). After the trial, the district court directed a defense verdict after apparently concluding that the evidence could only support a finding that the child's negligence had contributed to the accident. On appeal, we held that the child could not be charged with contributory negligence: “A child of that age cannot, as a matter of law, be held to have appreciated the danger and is not presumed to conduct herself as an adult person would under similar circumstances.” Id.Thus, the Court ordered judgment of dismissal for the defendants..
