And I mean that because after burying every other member of my family most of whom were killed at moments that they really should have had a right to have not been killed (my brother Rodney Allen Miller was shot by a State Trooper while he was unarmed on Christmas Eve by Minnesota State Trooper Chad Mills - I got him in wikipedia so you can look him up if you want)In any case since that happened I just haven’t had much desire for any law enforcement officer to ‘win’ any contest really and in this case it is not really arguable that the cops should (ignore Perry Mason back there because I will explain).You see criminal endangerment is wrong concerning a chargeable offense because it would sort of be like grabbing a guy out of his red-neck pickup truck because he has a rifle hanging on a rack behind the seat and charging him with murder… even though no one has died because he might murder someone… he could after all so… yea murder. But here is the kicker: because that dude and every other dude who is near a firearm so they could murder someone if they desired it or if there was an accident or … well point is that someone driving drunk is much more likely to hit someone and cause an accident than someone who isn’t right?No… not even close!381 fatalities in 2018115 alcohol-related fatal crashes (and the2018 stats include all intoxication into alcohol related so being high or drunk doesn’t matter most people killed have nothing to do with driving high or drunk).And in fact when you determine how many of those who died and probably were drunk or high compared to deaths in those accidents of other people the DUI/DWI claims concerning public safety are even worse:Drinking drivers themselves pay the price in 2018 78% of the 123 people who died in alcohol-related crashes were themselves the people whose drinking behavior caused the crash. The other 27 people were not drinking and were probably innocent victims.So… when you hear all of the cops bragging about how they are saving the public from certain doom by stopping everybody and arresting everyone that they can plausibly pretend were just about to kill an innocent person you can tell them to shut up like Perry Mason back there because they are lying to you.And it isn’t even a realistic lie when you think about it: out of 381 deaths from vehicle accidents drunk/high drivers caused 27 or so to be killed and if they want to be honest and explain what the real dangers are out there then 96 idiots killed themselves while harming no one else: and 258 senseless deaths were caused by other idiots who at least weren’t high or drunk so… the cops need more funding to prevent about 1/3rd of the well… there is at least a .33 % chance that if you die you know… then there is that right?Of course not but we need these brave heroes out there anyway so…Which forms another circle because you were supposedly not driving drunk or even drowsily driving higher than a kite on something like alcohol which is obviously dangerous because it causes one to be distracted but you are accused of driving after smoking something that makes you really really alert! In fact you were arrested for being too damn alert!Stimulants were actually created and perfected by your military to keep pilots and tank commanders what have you awake and alert for days.Of course you probably just heard Perry back there whining, “yea but what if it has been 4 days and the meth head is starting to fall asleep?”Well there is that isn’t there?And since we don’t have enough time or space to teach you how to argue and win by showing the judge that while you were really high because you just smoked a shitload of meth so you knew you were the safest person driving on that road at that moment and he should probably thank you for it… your only hope now is proving that whatever blood was tested and had meth found in it either wasn’t yours or those idiots at the BCA were still trying to catch a criminal instead of actually making sure that a criminal existed first by paying attention to the damn test they were supposed to do.Well since the average judge has no idea what smoking methamphetamine actually does to a person and there is a legal code that says it don’t matter because if you were he has to punish you… the fact is that after everything is said and done your only course of action is to deny deny deny and that is where the actual question comes in “how could the test be wrong?”Well first the good news is that there will be quite a few chances for you to yell at the pinhead prosecutor “We don’t even give a shit if the test was right or wrong yet because the State hasn’t proven that the test should have been done yet!” (I am kidding don’t yell that and now would be a good time to throw in that I am not a lawyer this isn’t legal advice and ayadayada and a yada talk to a lawyer!)NO you will not be yelling things like that but instead you will be allowing your lawyer to do stuff like that because they know how to do it with a lot more style than you do.They will be saying with a bit of aloof disdain things like: As the supreme court has clarified, an officer’s mistaken implied‑consent advisory will violate a driver’s due‑process rights only when the case includes three circumstances: (1) the officer’s statements inaccurately informed the suspected impaired driver of the legal consequences of refusing a chemical test; (2) the driver submitted to a chemical test; and (3) the driver’s submission to the test resulted from prejudicially relying on the officer’s inaccurate information. Johnson v. Comm’r of Pub. Safety, 911 N.W.2d 506, 508–09 (Minn. 2018).Meanwhile you won’t have to even be listening to all of that mumbo jumbo (but pretend like you are at least) because you will know that if you are asked anything by anyone about that blood being drawn by whoever took it you are supposed to say, “Well I was so confused and I would not have even allowed that to happen if you know… that Officer hadn’t confused me so much!”Then you will be told to go on your way because you have not been proven guilty by Perry Mason because that cop should actually be charged with theft for taking your blood away from you like he did! If there were really justice in our justice system of course that cop would be charged with stealing but the best you can hope for is your freedom I suppose.But if that doesn’t work hopefully you have a doctors report saying that you have dietetic issues OR the State has to prove that you don’t and that there was no sugar in your blood and if that wasn’t tested for then there probably was and so you see… if the State didn’t test for sugar in your blood then it can’t really say for a fact that the false positive results were not from sucrose (don’t spend too much time on it just think sugar) or in fact even metformin that your diabetic disability caused you to maybe be subscribed for your weak heart which Perry Mason is now attempting to punish you for in direct violation of the Americans with Disabilities Act so he should be arrested and go to prison and… yea just let your lawyer do the talking here.And of course the real problem again is the same that I pointed out: the BCA who actually performed the test that they claim prove you are guilty of something is an organization that was created to assume that everyone they deal with is guilty of something which is why criminal is right there in the name: why would that matter? Well it means that your right to due process and to have an unbiased and scientifically based test be performed and in fact your State legal code probably even required that cop to provide you with one sample of the blood drawn and inform you that you can hire your own biased fake scientist who can then argue that the BCA biased fade scientist is a hack and so on and so on.And that cop can’t just say, “Well yea I told the accused all about that for sure… really I did… trust me” because the State has to prove that this was not only said but that you understood it and that you decided to not do that or in other words you decided to give up that right and this is where Perry Mason is going to start screaming again because he thinks that your rights are stupid and he cries all of the time that no one seems to care about his rights about the States right to abuse any person it wants whenever it wants but just like you are never going to win the (everybody should be required to smoke a little meth before driving your honor if we really want to save lives that is) argument he is not going to convince the judge that the State must always prove that a right was intentionally given up by the accused before the State then raped that citizen because the idiot for some bizarre reason in fact did say ok I don’t need a right like that -You think I am joking again but I am not: and it makes me dizzy every time I see a tv show when a cop reads the miranda which tells the idiot that he has a right not to talk and then at end actual has to say, “do you give up that right” and the moron instantly says, “yes” because again most Americans trust the cops who well… why even finish that because if you are offered a chance to call any random lawyer and say, “I got a tube of blood here and if it costs $300.00 bucks to test it I suppose I will have to make payments but do you think you and I should find someone to test it who doesn’t apprehend criminals for a living?” well then screw ya because you asked for this… but we both know that isn’t the case and the cop simply didn’t bother to tell you that you had that right and that means he violated that right and so the BCA can shove the tube they tested right where Perry Mason’s nose is the warmest are you with me? Services include criminal justice training and development, forensic laboratory analysis, criminal histories and investigations.”That is right on the main web page of the BCA so they admit that they are biased and they intend to prove that every sample of every piece of evidence fails so… your right to an unbiased and scientific test only exists if your lab coat can get on the stand and explain how incompetent the BCA lab coats are because he is a real scientist and instead of meth in your blood he can prove that you had none.And how could that possibly be?Well the entire BCA was proven back in 2008 or so to have been faking tests and making up shit because of course they are cops and so they simply assumed everybody another cop says is guilty must be guilty so why not just say that they are guilty and not actually prove it?It turns out that other dudes in a lab coat can actually take yours away if you try to pull that shit so… the entire BCA underwent very big changes concerning both alcohol and meth testing but… they still are designed to look for criminals and are partners with the police so they do not even provide how many samples that they test turn out to not have any meth in them BUT they do something which is a bit odd for unbiased scientists and I have been able to argue in district court should get them kicked out of the witness chair.And this oddity came about because using the correct testing procedure “gas micromity” or some shit is really slow and really expensive so they decided that they would first test all samples known to have meth in them: because one cop told another cop that it did so of course it will be found to have meth in it eventually so…. “So when your sample comes in they do something called “Microcrystal testing” and this is well… it is objective and not a scientific measurement of anything: some chemicals are dumped into the sample which have been shown to form rather unique snowflake looking crystals if meth is in the blood and so a staff member quickly looks into a microscope and either says, “yep I see crystals” or says, “no… sadly there are no crystals there” sigh…Now the problem with that is that although the specific forms of these crystals (sort of like the theons or whatever Scientologists test for I suppose or the microorganisms from Star Wars or what have you) can be carefully examined and separated out from other similar ones there is a very clear coercion created for the quick and assumed declaration of seeing the crystals compared to not seeing them and of course again because whether they exist or not is subjective and up to the person who gets cheered if he sees them really quickly but who gets boo’ed if he doesn’t see them right away- (and this is likely the original hospital test that Joshua was subjected to so his positive was probably just a nurse with a hang-over) the simple fact is that a very high percentage of these so called positive crystal samples are not actually positive and when you get that little geek on the stand (and it is always the jr wannabes who are forced to say yep or nope because the qualified scientists have better things to do) then you can ask him why he didn’t then verify his quick guess really… by confirming that opinion by actually running the sample through a gasometry unit.You would be shocked by how often the little geek says something like, “oh I am not allowed to touch that sort of equipment because I am really not qualified to be considered anything more than a lackey when the PHDs are in the room (and then he will typically break down in sobs and tell the jury about the abuses that the real science dudes put him through) ok.. again just kidding but it doesn’t matter because if there is a better and more accurate test than asking Jr for his opinion and of course telling him firmly what his opinion needs to be before asking then not allowing your blood that more accurate test is denying you the same due process that another defendant would get if he or she was lucky enough not to wind up with that geek making whatever unsupported claim he made right?Sure - but here is what that odd thing that I mentioned earlier does: although the geeks shout out “ureeka” about 75% of the time that means that about one in four samples are found to be lacking any evidence of any meth (and again sugar or over the counter cough syrup or even Vicks vapo rub form such similar looking crystals that most of those 75% are probably false positives anyway) but instead of everyone sighing and accepting that maybe that cop was high himself or cheering and declaring that you at least were driving safely on Minnesota roads and Jr has just proven it…. yes dear reader: instead of that every time Jr says “NOPE!” One of the real scientists says, “Bullshit we will find something to charge this loser with!” And the sample is grabbed and put into the much more accurate gas analysis machine and guess what.. they then find minute samples of what are called precursors of both methamphetamines and amphetamines and why is that important? Two reasons really: first both of those substances would have the same chemical base you know.. since they both end with ‘mphetamines the fact that these scholorly geeks always include both in the report shows that they are trying to make the find more dramatic than it actually is AND … why would they only accurately test the samples that passed the less accurate test?Well they would only do this if the intent is to find every sample tested to be proof of guilt instead of what a real scientist would do: not care one way or another whether any given sample had or did not have what the cop who sent it says it had in it you see?I don’t practice law so when I am involved in any given case I can only submit my ideas to the lawyer in charge of the defense strategy team and I have to accept that he or she will either find value in what I suggest or set it aside because it does not fit within the defense strategy already formed: one reason why everyone in my family rejects a court appointed attorney and declares that they are going to be the fool that they want as a client BUT takes advantage of a sort of unique Minnesota option and states,”if the court would feel better concerning the potential lost time and expected mistakes I might make I would accept the appointment of a legal advisor who could take over if the court found my skills lacking - and this has never failed because every sphincter of every judge on every bench puckers when any defendant declares pro sey status and it avoids the very real problem of overworked and underpaid frustrated court appointed attorneys refusing to bring up something before the judge because well (sometimes they just don’t want to do the extra work and sometimes they believe it is the wrong thing to do in front of that specific judge and well… it is your ass who is going to never drive again and maybe sit in a cell for awhile and not their ass so sometimes you just get a loser who isn’t willing to fight for you) but for whatever reason you cannot allow any attorney to fail to present an argument that you could later appeal to a higher court because unlike Perry Mason and other tv shows once you are found guilty by judge or jury it is actually extremely hard and sometimes impossible to get newly discovered evidence or an issue that wasn’t argued in front of the district judge to even be looked at by an appeals court.And done!So there everybody desperate for answers to questions that I am sorry you have to ask: “What causes a false positive for methamphetamine?”It could be anything from laziness to incompetence to over the counter medication (in essence anything that can be considered a stimulant and yes that means even coffee or an energy drink) to automatic bias created by the relationship between the lab and the cops who set you up man!Because we know you are probably a damn meth head but we don’t care because the cops have to prove that and they can’t man… they can’t!(as I do a microphone drop and walk away without looking back)JK good luck and as soon as I leave you better split because every Perry Mason or wannabe Perry in the crowd is probably going to start that whole “my god that is so insulting” dance (that really looks like they gotta go peepee so it is more embarrassing than they know) I say good, let ’em because since this nation was formed by criminals and yes every founding father was guilty of sedition and treason but they were fine with that… the State must prove you are not innocent and if it can’t then you are!
