Names, amounts, etc. have been changed to protect the guilty.A number of years ago, quite early in my career, I represented a well-known US airline in a small-claims-court case that had been brought by a disgruntled passenger who claimed that my client had lost his luggage. He was suing for the value of the clothing, toiletries, etc. that were in the bag he claimed my client lost.Lost bag claims happen quite frequently, as one might imagine (duh!).Usually, the airline quickly settles out-of-court, gladly paying the (depreciated) value of the clothing and personal effects they lost, so long as the claim appears reasonable (and so long as the airline cannot produce proof that it did, in fact, deliver the bag to its actual owner — yes, I know, they have improved the baggage-claim technology these days so they can prove this, so don’t get any ideas. But, bear with me.) In addition to the airline usually being helpless to produce countervailing evidence, it was also rarely worth it, economically, for the airline to pay a lawyer, whose fees could easily exceed the value of the lost bag. In most cases, they would pay the damage and move on, as simply part of the cost of doing business.In this instance, the airline had some evidence they thought would make their case a slam-dunk AGAINST the claimant passenger, so they were willing to go to the trouble of hiring a lawyer (and paying by the hour) to take this tiny case to court.As a small-claims case, there was no pre-trial discovery; both sides just get up in front of a judge and state their case (and, of course, submit to cross-examination by the other side, if they put on any evidence). We had, going in, the claimaint’s own Lost Baggage Claim form he had submitted to my client, whom we will call Airline A, after the alleged incident. The claimant also helpfully attached a copy of this list to the Complaint he had filed in Small Claims Court. It itemized, in great detail, the things he claimed we had lost. I had something else in my briefcase, as well, which my client’s insurance carrier had obtained from another source. More about that later.The disgruntled passenger went first; he got up and, under oath, stated that Airline A had lost his bag when he was traveling from City B to City C on date X, and that the list he had submitted to the airline, and had attached to his complaint, was a true and correct listing of every item he had lost.Then it was my turn to get up and cross-examine him.
