I’m banned from selling this book…After the huge success of my previous book, ‘What Every Man Thinks About Apart From Sex’, which contains two hundred completely blank pages inside, a brilliant friend of mine called Viv suggested I follow it up with another book that was similar.So, I published ‘Fifty Shades Of Gray’, which also contained two hundred blank pages, this time in fifty different shades of grey.The back cover proclaims that 'the content gets darker and darker' as the book goes on...Random House, who publish ‘Fifty Shades Of Grey’ sent me a ‘cease and desist’ letter instructing me that I had to stop selling my book. I called their lawyers and asked them if they realised I was one of their current authors, as they publish my (real!) book ‘Ideas Man’.They said ‘Yes Shed, we do realise you’re one of our authors - and we’re still taking legal action against you for this new book…’.So, I had to stop selling my ‘Fifty Shades Of Gray’ book and now, they’re collectors’ items.The press even picked up on the story…All was not lost though!A publisher from the Netherlands contacted me, asking if they could publish the book there. I told them that they’d have to legally indemnify me, and they agreed… Their version looks awesome:I sometimes outline this story when I present as a professional motivational speaker, as an example that there’s always a way around problems in life and business…even legal ones!All my best, Shed x

True, Rahul is a loser and a serial loser. Every time he loses he comes up with a story to hide his failure. In the Karnataka assembly election Rahul on the advice of his mother gave a blank cheque to JDS, that they can form the government with anyone among their party members as CM. Thereby Rahul ensured the continuation of Congress rule in the coalition, which certainly hides his defeat.Congress acted quickly, making their case strong. Though the final decision rests with the Governor these sudden development has placed Congress in a strong position.Congress lost the moral authority to rule when they lost election ignominiously. Their support to JDS, which has 38 seats, half the number of seats of what it secured, looks ridiculous. Also Congress after the defeat should accept the same and desist from forming government either alone or in coalition. The mandate is against Congress. It's support to JDS is morally not correct.Also it should be noted that all the votes secured by JDS too are anti-Congress votes. If this party which throughout campaigned against Congress embraces the same party, such coalition is an opportunistic one and an unholy one too. This may not be acceptable to the people.The final decision rests with Governor. He can call any of the three one after another. Rahul by totally surrendering to JDS, will be losing its identity. Immediately Rahul may take pride by keeping BJP, away from power. But in the long run he is spoiling the party.

This is where many lawyers get it wrong all the time by always advising to go on the attack. Fortunately, the client is the client and gets to overrule the lawyer when other considerations make that the right thing to do from a broader business perspective.Google is already suffering from a perception that it's backtracked from its original "Don't Be Evil" promise. If I were their GC, I'd let this one slide, ideally with a polite-but-firm letter from trademark counsel stating that Google has rights in the mark, considers this use to be potentially dilutive or infringing, but in the interest of keeping the peace, won't pursue any legal action provided that the yogurt shop ___________ (fill in the blank with a laundry list of conditions designed to minimize likelihood of confusion). This kind of thing, called a "coexistence agreement," comes in many flavors (like yogurt) but almost always works when you're the famous brand owner taking on the little guy who poses no genuine competitive threat.
