The firearms were owned by his mother. Lanza murdered his mother before taking the firearms. Adam Lanza had access to the family’s firearm safe in which the weapons were normally secured. Because the firearms were owned by his mother and not him, Adam Lanza acquired his firearms by murder and theft.2 April 2012, One L. Goh, Oikos University, Oakland, California: Killed 7 and wounded 3 with a .45 caliber handgun legally purchased after passing a FBI NICS background check. Goh was deemed unfit to stand trial by two psychiatrists by reason of insanity, declaring that Goh had been a paranoid schizophrenic for at least the previous 15 years. Present federal law would deem Goh’s psychiatric diagnosis a disqualifying factor if reported to the NCIC.14 February 2008, Steven Kazmierczak, Northern Illinois University, DeKalb, Illinois: Killed 5 and wounded 17 with a 12 gauge Remington Sportsman 48 shotgun, a Glock 19 handgun, a .380 ACP SIG Sauer P232 handgun, and a .380 ACP Hi-Point CF380 handgun purchased after passing a FBI NICS background check. To do so, Kazmierczak had to have lied on his NICS application to hide his history of mental illness. That is a federal crime. Had Kazmierczak’s mental illness history been reported to the NCIC, the FBI NICS would have rejected his purchase application.16 April 2007, Seung-Hui Cho, Virginia Polytechnic Institute and State University, Blacksburg, Virginia: Killed 32 and wounded 17 with a 9mm Glock 19 handgun and a Walther P22 handgun purchased after passing two FBI NICS background checks. Cho had been deemed mentally ill and in need of hospitalization, had been detained in the Carilion St. Albans Behavioral Health Center in Radford, Virginia, had been ruled an imminent danger to himself by a Virginia Special Justice, and had a standing court order to seek treatment for his mental illness as an outpatient. The Commonwealth of Virginia has also been criticized for failing to report Cho’s history of mental illness to the NCIC as a disqualifying factor.2 October 2006, Charles Carl Roberts IV, West Nickel Mines School, Nickel Mines, PA: Used a Ruger M77 .30-06 bolt action rifle, a Browning BPS 12-gauge pump action shotgun, and a Springfield XD 9mm handgun purchase after passing FBI NICS background checks to take 10 6- to 13-year old girls hostage in a one-room Amish school house. Roberts shot 8 of the girls, killing 5 and wounding 3 before committing suicide. Roberts had earlier “confessed” to molesting some family members years before — a claim that the purported victims denied ever happened. A note Roberts left to his wife described despondency over the death of one of their children 20 minutes after birth. This act was a murder-suicide in severe and undiagnosed depression.21 March 2005, Jeffrey James Weise, Red Lake Senior High School, Red Lake, Minnesota: Killed 9 and wounded 5 with a Remington 870 12 gauge shotgun, a Ruger MK II .22 caliber pistol, and a Glock 23 .40 caliber pistol. Weise stole the weapons from his paternal grandfather after murdering his grandfather and grandfather’s companion.
