PDF Editor FAQ

In SaaS sales contracts, what are the pros/cons of putting legal terms and conditions in a linked document, rather than directly in the order form being signed?

In general, I'm of the opinion that you should always have all of the pertinent pages and documentation in a single package that is signed by the customer, whenever and wherever that is feasible. For a B2B product, sold by physical signature, that shouldn't be a problem; for a B2C product, it might not be so.The only real issue here is what to do if your EULA is later amended and the business who signs the deal does something that violates the amended terms. You've got a business records issue now, ensuring that you know which EULA terms each customer agreed to.

What type of gun control would you be in favour of and how would that work with the 2nd amendment?

Im really not in favor of any gun control outside of the basic safe handling principles that every person should know. I guess you could call that a form of gun control, believing in a standard gun safety course in every public school system could probably be considered that. Just a basic safe handling course. Something every school used to have “way back when”, pre 1960s it was extremely common. With over 600million firearms in the us in civilian hands and only a total citizenship of around 340million its not unlikely for a person to come across a gun or 2 in their lifetime.A basic criminal history background could be argued for, however we already have that and its shown zero effect at stopping criminal behavior with relation to guns.In short i believe there really isnt any constitutionally legal gun control argument. When signing on as a state you had to agree to the us constitution and bill of rights and that you as a state would abide by such. The second amendment is very clear. If you want it to be broken down into further context look to the original colonies state constitutions. The Pennsylvania one is extremely consise: article 1 section 21. Right to bear arms.“The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.”Thats very clear. In fact you couldnt make it any clearer.Look at the context of the time of the revolutionary war. Letters of marque were given out to private ship owners, essentially giving them the blessing of the American colonies to make acts of war and piracy against british war ships and shipping. These were the battle ships of the day. Easily capable of leveling a coastal town. Private people owned such ships at the time. Private ownership of cannon was not unheard of at all. Cannon were the tanks and artillery of the day capable of bringing down the walls of military forts and sinking ships as well as massive effect on people and soldiers when aimed their way.At the time of the revolution in the us, the people owned firearms that were of bettwr quality and better accuracy than the British military. They had BETTER firearms. This was why the British were so upset when colonists started to pick off leadership in their military groups from outside their own range of fire. The “sniper” as we know it today was born during the american revolution. And he was a hated and feared soldier in british military comand. In and before the 1950s you could mail order a gun. And not just any gun but guns with full auto capabilities such as the thompson:No questions asked as long as you mailed out the order form and proper payment you could have a gun delivered to your doorstep. There was no rash of mass killings or heavy crime related to that.In short:

A new software developer spent 4 days to make a simple HTML button and CSS, should I fire him?

I program websites for a living. One of the hardest things to explain to people is that programming is rarely a case of “just doing X”.Computers are very literal creatures. They will only do as they are told and they have no capacity to “think” for themselves. If the programmer has not anticipated all possible outcomes, then the computer will not handle them.In your “just a button” case, at a minimum your developer has to handle:design and placement of the button; is it just a default button or has it been styled to fit in with the rest of your website? CSS styling is an absolute pain. Even if your developer used an existing template, it can be time-consuming. If he has had to design the button from scratch, it can take an absolute age to get right. There are people who do nothing else except CSS styling - that’s how much of a specialism it has become.a button is not just a button: it is an object which requires proper placement on your page. These days, it also has to be responsive to different screen sizes. The days of plonking a button at the bottom of a form are long gone. Nowadays, the placement has to work at a large desktop size, on a laptop screen, on a tablet, on a mobile …. It can all be done but the developer has to define the placement rules for each and every screen size he has chosen to cater for. In the absence of such rules, modern web browsers can make a “best guess” about the developer’s intentions but the browser cannot “know” and we have all seen those websites where elements overlap each other at small screen sizes or appear all over the place at larger sizes because the rules were not in place. CSS styling, as I know to my cost, can eat up the hours faster than a taxi-cab meter can rack up the fare. There are improvements in the pipeline with CSSGrid and other specification changes but they are still far from universally supported by all browsers and we are some years away yet from the time when all websites will embrace the new CSS goodies.data collection: behind the scenes, the button is actually doing an awful lot more work than you think. If it is working in conjunction with a shopping basket, then it needs to know that the shopping basket exists. It also needs to know what is in the basket. Depending on what you asked the developer to do, he may or may not also have had to write the shopping basket or adapt it from existing code to suit your purposes.intelligent behaviour : the developer has to put code in place to handle cancelled orders, amended orders, normal orders. Once he has done that, he has to send the appropriate server request to your webserver (done in the background via a technique known as AJAX). What happens if the server is down or busy and cannot handle the request? The computer does not know what to do unless told. So, your developer has to tell it what to do if all goes well (book out the stock, capture the customer details, handle payments, inform user that the order is successful) and work out what to do if the stock has already been sold by the time your customer clicks the button or the server does not respond or payment cannot be taken. Again, he may be able to use existing code to some extent but, in my experience, existing code rarely does exactly what you want it to do: it almost always needs to be tweaked - and tweaking means more testing: better the developer finds the problems than your customer does.redirection : once the button has been clicked and the order processed (whether successfully or not), the developer has to inform your customer of what happened and - presumably - take him elsewhere on your website, depending on what the outcome was.Swans look very majestic as they glide serenely over the surface of a lake, but there is a hell of a lot going on under the water. Obviously I don’t know what you actually paid your developer to do but I can easily imagine there was an awful lot going on of which you were blissfully unaware!Final point: most developers are incredibly poor at explaining the complexities of their job in terms that laymen can understand. It took a couple of years before my other half truly understood that the real art of the developer is to disguise just how much work the computer is doing every time you click on something - and how much testing the designing of those things requires. Like security guards, you only really notice us when something goes wrong - which means either something we did not think about or a major infrastructure failure outside our control.
