However, the minimum requirement for property damage is $5,000 in California! This is shockingly low!That means that if a person (Bob) hits a Maserati and causes 40k in damage to the car (and it is Bob’s fault), Bob’s insurance will only pay 5,000 to fix the Maserati (assuming Bob has the minimum liability insurance amount). Now imagine Bob damages 5 cars! The limit is still only 5,000 dollars! So…. the other car owners better hope they have their own collision coverage that will take care of the damage.More importantly is the case of bodily injury. In CA, the law requires minimum liability coverage of $15,000 per person and $30,000 per accident. Also, in CA a lot of people break the law and don’t have insurance at all! This freaks me out because you don’t even have to be that hurt to spend 15k in medical bills. Now imagine if you lose a leg or become paralyzed? Scary I know, but it happens.So, Imagine Bob has minimum coverage. If Bob gets in an accident with Joe, Bob is at fault, and Joe breaks his back, then Bob’s insurance has to pay. But, what if Joe’s medical bills and other costs are $100,000? Bob’s insurance only will pay $15,000.This is a common situation, believe it or not. In this situation, Joe will look to his own insurance for payment of the remaining $85,000. BUT IMPORTANTLY, the only way Joe’s insurance will pay is if Joe has “Uninsured/Underinsured Motorist Coverage.” Otherwise, Joe’s insurance will tell him too bad, sucks for you. (Joe may be able to get medical help through his health insurance if he has it, but he won’t recover for his pain and suffering or other costs.)Uninsured/underinsured bodily injury insurance covers medical expenses, pain and suffering, loss of income and funeral costs for you and all passengers in your car. Yes, ALL THE PASSENGERS IN YOUR CAR! Imagine getting in an accident with your children in the back seat. You want them covered.Lot’s of people have very little or no “Uninsured/Underinsured Motorist Coverage.” They think that because they have great collision coverage, it covers them if they get hurt. They don’t realize they are only protecting people, and themselves, if THEY ARE AT FAULT for the accident. They aren’t protecting themselves from other drivers who are at fault. Say you are hit in an intersection because a driver runs a red light. Well, you better hope that driver has good coverage.Bottom Line: always match your “Uninsured/Underinsured Motorist Coverage” to your liability limit. And, if you have a lot of assets, make it high. Because if another person is hurt in your car, they can get a judgement against you!Also, what happens if you get hit while crossing the street by a car driven by an uninsured/underinsured driver? Well, you are covered only up to the limit of YOUR “Uninsured/Underinsured Motorist Coverage.” You aren’t even in a car, but your car insurance is what is protecting you. If you want to recover for your medical bills and pain and suffering, you have to have “Uninsured/Underinsured Motorist Coverage.” So check your policy today.*This is not intended to be legal advice.
