If I'm understanding it correctly (and if a better/more informed answer comes along, I'll defer to that person), the general House operating rules (Rule 22, Clause 4) indicate that if there was a bill that gets stuck between the House and Senate because of amendments to that bill, that ANY member of the House (of either party) could call for the amendment(s) to be shelved and call a vote on the original bill. So with regards to the current budget battle, under those rules, a Democrat could've called for a vote of the full House on whether to accept the so-called "clean" resolution the Senate and Obama have been asking for.HR 358, Section 2 supercedes Rule 22, Clause 4 specifically for the clean resolution so that only the Speaker or his designee could call such a vote for that bill. Now, the vote on the Senate resolution literally can't happen unless one person (Eric Cantor) allows it to happen. (Kudos to Ian McCullough for the clarification.)So would allowing such a vote have opened the government? Maybe, maybe not. That assumption still depends on what moderate Republicans (in particular) would do in an open vote. On one hand, the so-called "clean" resolution is fairly close to the Ryan budget in dollars... BUT it still has funding for the ACA/Obamacare. So moderate Republicans would have to decide whether overall dollars or ACA is what's important to them. If they were to vote with the Democrats, they might get attacked from the hard right in their primaries next year by a Tea Party-approved challenger. If they vote with the Tea Party Republicans, they possibly hand their Democratic challenger powerful ammunition in the next election cycle, depending on how far right their district is. So it's not a slam dunk that the government would re-open, but at least the votes would be on the record and moderate Republicans would have to come out in the open and pick where they stand.
