He just drove off. The Sgt saw this. He stepped in front of the moving car and pointed the rifle and pointed at the colonel. The car stopped. The car was searched.The colonel lodged a complaint to the base commander. I heard rumours that the colonel was “severely dealt with instead”. We speculated detention barracks or court martial. As CPLs we like to speculate our officers getting charged. Dunno why also.

What is the story behind the India-US diplomatic row (L'Affaire Khobragade)?

The story is that the US Attorney for New York (a federal officer) filed charges against Dr Khobragade, Deputy Consul General at the Indian Consulate in New York alleging that she had committed 1) Visa Fraud and 2) issued false statements/documents in the commission of that fraud.The criminal complaint filed said that she presented a contract that complied with US law as part of the application for a visa to enter the US for a personal servant. The contract met the legal requirements, including that it would pay a salary at or above US minimum wage. Such a contract is a requirement in obtaining a visa for a servant.The complaints says that after the visa was granted, Dr Khobragade then created a second contract with the servant that provided for a much lower salary, one that was below what was required for both obtaining the visa and to comply with US law.For whatever reasons (and the reasons are not pertinent to the charges), the servant brought a copy of the second contract to the attention of the US government as evidence that Dr Kobragade was in violation of US laws.Based on the existence of the two contracts -- one legal, one not legal -- the US Attorney proceeded to file criminal charges against Dr Khobragade and, once a judge had approved the complaint, caused her arrest to be effected. (There are conflicting reports on whether State Dept's Diplomatic Security or the US Marshals Service first arrested her. In any event, the Marshals handled her preliminary in-processing prior to turning her over to the NYPD for detention until arraignment. NYPD also did its own in-processing before putting her in a common holding cell.)There is a dispute about whether Dr Khobragade, as an official of the Gov't of India, traveling on a diplomatic passport, had diplomatic immunity.The US Gov't -- which establishes who does and does not have immunity in the US -- says that as a consular officer, Dr Khobragade has only Consular Immunity -- a lesser form of immunity than Diplomatic Immunity. The two forms of immunity are described/prescribed by two different international agreements: The Vienna Convention on Diplomatic Relations and The Vienna Convention on Consular Relations.Those who have Diplomatic Immunity are identified on the Diplomatic List. Those with Consular Immunity are identified on the Consular List. Dr Khobragade's name appears only on the Consular List.Following her arrest, Dr Khobragade was processed into the US justice system as any other accused felon. The crimes she is alleged to have committed hold a potential punishment of fines and up to 15 years in jail.Part of that process included appearing before a judge to determine whether she would be granted bail or be required to await trial within a jail cell. The judge granted bail, in the amount of $250,000, and she was released to await trial.Those are the facts of the case.There are other issues in play however. Many, particularly those of Indian origin, are angered at the way in which Dr Khobragade was treated during the process, from the place of her arrest (in front of her child's school), to her being handcuffed, to her being subjected to a strip and cavity search, to her being placed in a common holding cell while awaiting presentation before the judge.Some bring in extraneous matters concerning the servant, the servant's family (who were given visas to enter the US), Indian court orders, alleged conspiracies, etc. Others bring in allegations made about Dr Khobragade and her possible involvement in some scandal in India. All of these are of no importance to the actual case.
