I was a juror on a federal civil case alleging police brutality. A government process server was trying to serve a doctor in a very exclusive neighborhood. The doctor, who had been ducking service, called 911 and said there was an armed burglar trying to break into the house and described the server and his car. The police responded and had the server get out of the car and get down on the ground. He showed his government ID and the police helped him up, took the warrant and served the doctor. The server alleged police brutality. To me (and the other jurors) it seemed like a stretch.The plaintiff’s lawyer apparently had a reputation as being kind of a wild card personality. The judge was an elderly man who looked like he was half asleep during the trial. When the plaintiff’s lawyer was questioning the plaintiff, he asked him if he thought there was a reason the police responded as they did; the apparently desired answer was that the defendant was African-American. The defense attorney objected to the question, and the judge sustained. The attorney then asked the same exact question several more times, followed by an objection and sustaining of the objection.Finally the judge told the plaintiff’s attorney to move on, and if he asked the same question again, he would dismiss the defendant as a witness. Amazingly, the attorney asked the same exact question again! The judge blew up, started yelling at the attorney, excused the witness, declared the plaintiff’s case closed and ruled with a directed verdict for the defendant, and let the jury go.A wild ending to a very short trial.
