Are the police able to change the charges or do they have to file new ones?”As most others have noted, the “police” don’t actually file charges in criminal cases; the local prosecutor is the one who reviews the report(s) in a case and decides what, if any, charges are to be filed in court.Yes, it is very possible that the local prosecutor may decide to charge you with the same crime(s) as you were arrested for, or may decide to “bump” the one to a felony. It’s also possible that the prosecutor may decide to drop a charge or dismiss the case entirely, although your worry indicates that you don’t think that’s likely to happen.I worked in Illinois and it was not unusual for the local State’s Attorney to file charges which were only remotely similar to those the police described in their reports. In some cases, the charges were less serious than the crimes alleged in the Arrest Without Warrant (AWOW) booking paperwork. In others, the S.A. filed more serious charges, leading to today’sWar story alert: I made a traffic stop one night and found the driver to be belligerent, argumentative, and to have been drinking. He was only 19, but his behavior was so egregious, I eventually arrested him for resisting/obstructing a police officer. I don’t really know how she managed to pull that off, as Zero Tolerance complaints involve a few State-mandated forms being filled out at the time of the complaint. None of those were done, no citation was issued, yet the S.A. filed the complaint anyway.Had I been aware of the situation as it was unfolding, I am pretty sure that the defense attorney would have received an anonymous call from someone who had been present and was certain that the Zero Tolerance hadn’t been processed the correct way…. As it was, I complained to my Captain, who forwarded the complaint to the Chief, who decided it wasn’t worth the effort to complain to the S.A. about it.
