Some examples include flying a drone too close to an airport or stadium or higher than 400 feet.The big takeaway from the new drone data is that 2015 saw many more flying robots fly in restricted areas than in 2014. Before it started releasing detailed drone incident data, the FAA has previously said that there were 238 drone sightings in all of 2014.One incident described in the FAA’s latest report includes a Texas airplane pilot spotting a “big black drone” to the left of his plane at 3,500 feet. The pilot didn’t take any evasive action to move away from the unmanned aerial vehicle, but he notified the FBI, the report said.But some aircraft have been knocked off course by drones. Last December, a report by a Bard College research group on drone incidents said that from December 2013 through September 2015, there were 28 incidents involving airplane pilots taking evasive action to avoid a drone while flying.Another incident described in the FAA’s accounts involved an airplane pilot in North Carolina who noticed a drone was flying roughly 1,000 feet below his aircraft, which was 7,000 feet in the air. Last week, the FAA also released a report that said drone sales are expected to reach 7 million in 2020, which is more than double the 2.5 million the agency anticipates this year.Current FAA safety guidelines for drones recommend consumers not fly drones within five miles of an airport or intentionally “fly over unprotected persons or moving vehicles,” according to the FAA. Flying drones under the influence of drugs and alcohol is also out of the question.Reports of unmanned aircraft have increased dramatically since 2014. Safely integrating unmanned aircraft into the national airspace system is one of the FAA's top priorities, and the agency wants to send a clear message that operating drones around airplanes and helicopters is dangerous and illegal."We have a number of educational initiatives with our government and industry partners to teach drone operators how to fly safely, including the drone registry we launched last December," said FAA Administrator Michael Huerta. “But enforcement goes hand-in-hand with education, and we will take action against anyone who operates irresponsibly to the full extent of the law.”The FAA wants operators to know where it's legal to fly their drone. Unauthorized operators may be subject to stiff fines and criminal charges, including possible jail time.The other issue bothering the FAA is the danger to people on the ground from low-flying drones.FAA Gains Traction in Developing Rules Governing Drones in Flight Over PeopleOn April 6, a committee convened by the Federal Aviation Administration (FAA) released its recommendations for permissible flights of Unmanned Aircraft Systems (UAS) over people. The FAA’s Micro UAS Aviation Rulemaking Committee, consisting of advocacy groups and companies in the UAS industry, presented the FAA with “recommendations for a performance-based standard that would allow small UAS (under 55 pounds) to be operated over people who are not directly participating in the operation of the UAS or under a covered structure.” The committee said the risk posed by certain UAS flying over people is “injury or death to persons on the ground.”The recommendations include the creation of four categories to assess and limit risks to persons on the ground. The following are the four categories recommended by the committee:Category 1: For a small UAS that weighs less than 0.55 pounds (250 grams), operations over people would be permitted under very limited restrictions. Category one is designed for a toy UAS or a small UAS approximately the size of a smartphone that poses a low risk when flown over people.Category 2: For a small UAS weighing between four and five pounds that creates a low risk of serious injury based on its energy profile, operations over people would be permitted as long the operator maintains a minimum distance of 20 feet above people’s heads or 10 feet laterally away from people on the ground. There are a number of small UAS currently on the market that are expected to fit within this category.Category 3: For a small UAS weighing between six and eight pounds that creates a moderate risk of serious injury based on their energy profile and meets certain manufacturer certification requirements, operations would be permitted over some people if they are incidental to the operation. In this category, operators would not be permitted to fly over crowds of people, but could fly over a closed or restricted access worksite or over transient or incidental pedestrians so long as the overhead flight was not sustained.Category 4: For a small UAS weighing between six and eight pounds that creates a moderate risk of serious injury based on their energy profile and meets certain manufacturer certification requirements, operations over people would be permitted in accordance with a required documented risk mitigation plan. In this category, operations over crowds would be permitted. The documented risk mitigation plan would have to meet voluntary consensus standards to be established later.
