I did not hesitate to hire a criminal defense attorney who specialized in those areas, even though the second one was so absurd, that was dismissed during arraignment. The first one was equally Absurd, a DUI, that you literally wouldn’t believe the story if I told you, but in this case I was going up that you can stay completely corrupt police department, with several officers involved in the blatantly illegal arrest, so I needed a heavyweight.It’s funny, because I have had a love/hate relationship with the police my whole life. I grew up in an apple and area of Long Island where we had our own Police Department, and was very friendly with all of them, and naïvely thought that they were that way with everyone, until several people who are visiting our house on separate occasions, or pulled over by our police, and they told us how unbelievably rude and discourteous they were to them. I realized at that point it was almost at incestuous relationship that we had with that police department. There were only about 2200 residents in our town, so anytime we got pulled over, and they instantly saw Who we were, they told us to have a nice day, and went back to their squad car. It was very likely because we were so directly paying their salaries, their pensions, contributing to the PBA each year, etc.In my work in politics, I also had a good relationship with many of the brass and the officers in many NYPD precincts that were in districts where I worked for the state legislators or congressman in that district, and we worked with them on PAL programs and other community programs. Was very friendly with them as well.Then in 1995, I was driving home from upstate New York, Oneonta, visiting my girlfriend, when I was about 1 mile away from getting on the New York State Thruway in Kingston New York. This is another very long story, but I was pulled over for speeding, which I was, and the state trooper that pulled me over Was seriously mentally disturbed. When he came and approached my car, he seemed very matter of fact, the way most NYS troopers are. I got out of my car as I was not feeling well, which is actually why I was speeding so I could get to the very well lit entrance of the Thruway and pull the car over and live down in the car. Where we were, was very dark, nearly pitch black, and I did not want to stop the car there at midnight. I actually vomited while I was outside of the car, even telling the truth bro just give me a ticket, I didn’t care. Well, he turned out to be the ultimate definition of Jekyll and Hyde. He came back with the ticket and license and insurance in his hand, and I was actually relieved that I would get out of there, but when he approached me, he took the paperwork and punched it in my gut. He then proceeded to get in my face like a drill sergeant, and spend about 60 seconds telling me that if he ever saw me in Kingston again, he would fucking kill me. At that point, I started to see him reach with his right hand towards his holster. I don’t know, or don’t remember, whether that is where the side he kept his gun was, but within a split second, he was obviously nuts, so I just ran to my car, got in it, and floored it. I went to the nearest NYS police barracks. Went through the process of explaining what happened, as I was pretty freaked out. After giving three videotaped recordings to a sergeant up there, which required me to make three round-trip trips from Long Island to Kingston, about two hours each way. After all of that, I get a two sentence form letter from the New York state commissioner of the state police telling me that there was nothing to find anything supporting my allegations in their investigation. I have a lot of political contacts, and I normally hate using them for my own benefit, but in this case there was no way I figured this guy was not going to kill someone someday, so I knew one state assemblyman who was close with the commissioner of the New York State police. I wasn’t even suing that department civilly, which I should’ve been retrospect. Honestly my only concern was that for other people, and this lunatic having a uniform, a bitch, and a gun, patrolling the streets. Amazingly after my assemblyman Friend God valves, within a week I got a registered letter from the same commission are telling me they were so sorry they made a mistake in their investigation, and that the trooper was terminated and Facing Criminal charges.In 1998, I was managing the campaign for that same assemblyman in a four-way primary to get on the democratic ballot for the sea that Chuck Schumer was vacating in the House of Representatives when he was running for the U.S. Senate. There is a funny story with that one that is unrelated, as to how I accidentally got Anthony Weiner elected in that primary instead of my candidate. I think I answered that question once before. amazing and crazy story that if I had not done what I did during the six hours for the polls opened two months for the general election, for the primary, nobody in the world would have ever heard of Anthony Weiner. Anyway, about six weeks before the primary in September, Our race was getting a lot of media attention and I decided to hire security for my candidate. Someone gave me the name of an NYPD cop who was on leave, so I hired him without that much of an interview. His job really wasn’t very difficult. Just to be with in the general presence of the assemblyman whenever he was out campaigning. About two weeks later he came into the headquarters, into the back office where I had my desk and the desk Of my colleague. He basically demanded that I double his $1000/week salary, which was about as much as anyone was making on the staff. Not that I would have given it to him anyway, his job was so easy, but I told him truthfully we did not have the funds.I told him he was supposed to be at the beach right now anyway with the candidate, and to please go there. I didn’t look down at some papers on my desk, pretending to read them, when really I was just waiting for him to leave. All of a sudden I hear I then fiancé, at the desk to the left of me, scream my name. For some reason I just ducked, and the next thing I knew was that a Snapple bottle exploded against the file cabinet behind me. He has fired a full Snapple bottle at my head from about 10 feet away. He then ran out of the building and was not seen again until be asleep everything was reported to the police and he was indicted several very serious Charges. But the absolute asinine arraignment judge released him on $50,000 bond, and Did not even ask him to turn in his passport.I knew that we would never see him again, and I turned out to be correct. We think he went to South America where he had some family, and occasionally US marshals give me a call telling me they are still looking for him, but I am not holding my breath.Actually, there was a point for me telling you all of this. You would think after those experiences, I would be petrified of the police. After each of those two incidents, for a couple of weeks whenever I saw a police car, yes I was a little intimidated. But I also had friends in the police and after law school with the FBI, and my wallet is filled with every kind of police Or FBI card given to friends, mini badges, etc., and the fear quickly subsided.And I had no contact with the police until January 1, 2014, when I was falsely arrested for the Dui. I would love to tell you the story it is so unbelievable, but I’ve told it before, and I just don’t have the time right now to go over it again. So for that I did hire a lawyer. But actually, part of the problem was that I was living in Nassau County on Long Island, where it is standard procedure in New York State, and all 62 counties, but if you are arrested for the first time for a DUI, the DA of the county will offer you to knock down the misdemeanor to a traffic violation that we have that is unique in New York state where it is called driving While ability impaired by alcohol. That technically means that you are BAC is between .05 and .07. My BAC was .00, part of the utter corruption of this, But I did have an anti anxiety drug That I had been taking for 15 years, and had as much effect on my ability to drive as an aspirin did. I also voluntarily walk into the police station to report a minor fender bender which is what got me arrested. If I had never walked back into the police station on my own volition, I never would have been arrested in the first place. Just one of about 30 insane things that happened that day.Anyway, The district attorney, who is currently in Congress where she belongs, ran on a zero tolerance platform for anyone arrested for any DUI. It is literally unheard of, to prosecute a first-time DUI offender, if there were no injuries involved, etc., and especially if you got yourself arrested the way I did. LOL. I then thought of a motion we could file for lack of probable cause for my arrest. There were about 11,000 Arrests for Dui’s during her time as district attorney, and from what I found out, she never once opened the file of a single police report to even look at the possibility that maybe one of those 11,000 arrests was improper, and therefore drop the case. But when I filed the MTD for a lack of PC, A copy was sent to her, and I think she realized at that point that they would most likely lose the motion and the case will be dismissed by the judge. So for the first time in her career, she offered me that option of driving while impaired by alcohol, which is a traffic violation and not a Misdemeanor. I really did not want to plead guilty to anything, as I was guilty of nothing, but the main witness I had to prove much of my innocence and who’s saw most of the corruption that occurred with the police department, which the only reason they cared At all, Was my father, who was very sick. It was because I had hit one of their cars, just a tiny tiny dent That they even arrested me in the first place.. And it had nothing to do with my cognitive Ability. So I did not want to put my father through anymore of this, as I had already appeared in court every two weeks for the first six months of that year. So I took the deal which would not give me any criminal record. My license was suspended for 60 days and I had to perform 50 hours of community service, something I normally wouldn’t mind doing it all anyway, but this actually was heavy construction or a private consortium, even more blatant corruption in the county. Insane.My point about all of this was that I then became petrified of the police after that experience. There was something about getting arrested, even for something so minor, and may be because I am an attorney, used to being the one defending people, going through the process of being booked and everything, where they kept me handcuffed behind my back for 16 hours that day. Where the fuck was I supposed to go while in a police station with dozens of officers watching me? It was actually a violation of New York State law to do that. I later found that out.The other arrest, I easily could have handled myself because as I said it was dropped without me even having to say a word or really my counsel. But again, that was about three years later, and it reignited my great fear of the police again.The main point of this long soliloquy was just the very strange reaction that I wasn’t very afraid of the police even after two very violent altercations, but was, after two ridiculous arrests, all which were dropped. Psychologically, I guess a very interesting analysis of the situation would be in order.
