This assumes, of course, a properly filed and fully documented I-140 and I-485 where an RFE will not be needed.If it is the spouse, again the per country immigration caps apply as above and for non-oversubscribed countries the wait is about two years at present for a visa to become available and then if I-485 will be filed in the US, add that processing time.The advantage a spouse has over an employer, especially if the immigrant is from an oversubscribed country is that if the spouse becomes a US citizen while their spouse is still in the queue, the I-130 classification automatically changes to Immediate Relative of US citizen and there is no cap on IR categories, so an I-485 or overseas visa application can be processed immediately at that point.As to actual processing time, this varies based on numerous factors:Was the petition that was filed complete with all supporting documentation? A petition that generates a Request for Evidence will take much longer than one that does not.Is an immigrant visa number available? If a number is not immediately available due to the immigrant’s country or the overall category being oversubscribed, then once the petition is approved, it is sent off to NVC to be held until a number becomes available.As the time of processing of an I-485 or DS-230, what is the workload of the processing office? This will vary widely from office to office and cannot be accurately predicted.
