I wouldn't describe this as crazy, but just dumb.I was working for a Canadian sub, of a multinational technology company and was recruited to take a promotion and move to corporate hq. I was admitted to the US using a L1A visa. After 3 years, a couple of different jobs and a promotion, the company ran into some patent difficulty and I was layed off.Given the choice of moving back to Canada or staying in California, I realized how much I hated winter and started to look for a new job.In short order, I found myself a position with visa sponsorship at a startup using a TN visa. I left the country and reentered under the new visa. No issues at all.A year later I met a VP at a major multi billion technology company who wanted me to join the team. I accepted. The company had deep expertise and staff dedicated to handling visa issues, so I didn't think there would be any issue. The paperwork was done and again, I left the country to be processed and readmitted under a TN visa.When being processed at the port of entry, in addition to current visa application, you must submit all your previous visa information as well. As this was my 3rd visa application in 4 years, the package was inches thick. It contained job descriptions, corporate financial reports, educational credentials, CV….The officer sits down and begins reading. He glances through my previous visas and then starts a detailed reading the job description of my current application. He said visa denied.What? Why??He said as I was entering under a TN, management consultant visa, there is a problem with the job description. Under the tasks listed it said…The candidate will perform the following tasks…That was not allowed. I was told as a consultant I may direct or perform tasks occasionally, but not as a job function. Entry denied. Have a nice day.I started making calls and spoke to the lawyer at the high power Silicon Valley law firm who prepared my visa. He was shocked. We reviewed the discussion I had with the officer to make sure that I said nothing improper. He reviewed the job description and said, I'll FedEx you a new visa application package today. He continued, tell the officer, if he rejects the new application, I will be in a flight to Canada and will personally escort you through the border.2 days later I'm back at the airport with a new visa application in hand. As luck would have it, I get the same officer to review my package. He of course recognizes me and starts reading the updated package and says “it's amazing that your job description has changed so drastically, so quickly”. I mentioned that the corporate lawyer was prepared to fully assist me in this process. He looked at me and then approved my visa. I boarded the plane and I was on my way.So what changed in my application??? One word.The lawyer changed the word will to shall. That's it.
