This would allow for the patentability of isolated DNA with the intent of encouraging further development in the field.That said, this is just the initial draft and Senators Tillis and Coons have gone with the most extreme scope of patentability. It is extremely likely thatfundamental scientific principlesproducts that exist exclusively in naturepure mathematical formulaeeconomic or commercial principlesmental activitiesare all going to be back on the exemption list.This gets us to the actual question. Myriad represents good settled law and the entire biotech industry should be pretty satisfied around the current status quo.Furthermore, times have sort of changed. When BRCA1 was discovered, it wasn’t a trivial effort to isolate the gene. Now, a high schooler can do it i.e. an rando with ordinary skill can figure this out. If isolating DNA can get you a patent, there really is nothing stopping a bunch of high schoolers from patenting the entire human genome.Where I think the real battleground will be around abstract ideas. Alice Corp v. CLS Bank International wasn’t about software but about the application of an concept for financial transactions. If concepts become patentable, that has much more significant consequences on IP because this becomes more boundless.
