I absolutely agree with Katerina Gemskaya.In no way do I see a scenario where a device or an application can replace a human tour guide. Namely because machines can’t replace the physical interaction between people.And let me get one thing straight, applications can’t replace real people. However, I’m really curious what might a sophisticated AI achieve in couple of years…? Decades, perhaps?Some might say that tourists are now more focused on digital technology. And they are, but that doesn’t mean that people have given up on human interaction.How Is Technology Changing The Travel And Tourism Industry?Everyone has a mobile device and all sorts of travel applications on it such as maps, weather forecasts, and apps like TripAdvisor and Smart Tour Guide.Also, there are a lot of applications which you can use to customize your itinerary.And that’s all nice and dandy, BUT an application can hardly for example, improvise a great story on the spot. So we’re talking about strong improvisational, communications, and storytelling skills.Another key to remember, machines don’t have a contagious enthusiasm. Right?It’s the same as with writers. There was a lot of talk on the subject of copywriting and AI. Some things need that human touch in order to work best.However, the travel industry should keep up with the new technology trends. Tour guides must be equipped with the latest tech in order to best showcase their skills and be a better tour guide. Prometheus, Association for Molecular Pathology v. Myriad Genetics, and Alice Corp v. CLS Bank International. These revolved around patents around natural law, products of nature, and abstract ideas respectively. This would allow for the patentability of isolated DNA with the intent of encouraging further development in the field.That said, this is just the initial draft and Senators Tillis and Coons have gone with the most extreme scope of patentability. It is extremely likely thatfundamental scientific principlesproducts that exist exclusively in naturepure mathematical formulaeeconomic or commercial principlesmental activitiesare all going to be back on the exemption list.This gets us to the actual question. Is this a good or bad idea? I think Association for Molecular Pathology v. Myriad Genetics settles much of this. SCOTUS explained in great detail what can be patentable and what can’t be patentable. Further more, they outlined several examples of how patents around genetic information can be made and how they can be used even if gene patents aren’t allowed directly. One can easily create a patent over the application of a gene and that in of itself can be worth billions as we have seen with the CRISPR Patent Battles. In my humble opinion, AMP v. Myriad represents good settled law and the entire biotech industry should be pretty satisfied around the current status quo.Furthermore, times have sort of changed. When BRCA1 was discovered, it wasn’t a trivial effort to isolate the gene. Now, a high schooler can do it i.e. an rando with ordinary skill can figure this out. If isolating DNA can get you a patent, there really is nothing stopping a bunch of high schoolers from patenting the entire human genome.Where I think the real battleground will be around abstract ideas. Alice Corp v. CLS Bank International wasn’t about software but about the application of an concept for financial transactions. If concepts become patentable, that has much more significant consequences on IP because this becomes more boundless.
