No unless you have applied for a temporary placard. You can get the application for a temporary placard online from your BMV and your doctor has to sign or approve the item as necessary. They will also deem how long you need to have the placard for according to your surgery and recovery. Then you can send it in toy our BMV. I think maybe you have to pay for a temp placard too, but I know if you are deemed fully disabled, it is free at least in Indiana. You’ll have to read up on it according to your state. What I am quoting is from Indiana too which is probably pretty general from state to state with a few variations from here to there.

I am not a lawyer so free advice give is worth exactly that. I doubt that this is your neighbor although the question is unclear whether the development is part of an HOA or if this is actually on street parking.If it is on street, calling the police non-emergency number should result in the neighbor receiving a visit and possibly issued a citation. If it is subject to the restrictions of an HOA, a call to their office should have similar effect.There are lots of regulations governing the us of handicap placards and tags but those for the spaces themselves are less well defined.
