Oh, that’s easy.It’s 1993, and Brett Kavanaugh has put in to be a law clerk for Supreme Court Justice Anthony Kennedy alongside his fellow Georgetown Prep alum, Neil Gorsuch. This triggers Kavanaugh’s first FBI background check, which will go back 10 years into his history.After the usual criminal and credit checks and verifying the information Kavanaugh provided to them at the start of the process, the FBI goes to personal interviews.Family and other close relations, Yale graduates and work colleagues are obvious enough to find; but the background check also requires interviews with friends and other acquaintances. Kavanaugh, of course, provided the FBI with a list of close associates in the documentation he provided at the beginning of the clearance process, but the FBI also asks the other people they’re required to interview, “Do you know anybody else associated with Mr Kavanaugh with whom we should speak?” and a few more names come forward.The FBI runs these people through their databases to be sure that there’s no association with known criminals, but won’t go much further than that into their personal histories.Of course, many of the people who surface in this process are going to be Kavanaugh’s best friends who when asked by the FBI about Kavanaugh’s potential involvement in any criminal activity (which may or may not also implicate them) will say something to the (abridged) effect of:Who, Brett? Nah, he’s a Boy Scout. I mean, maybe some stuff – like, ‘Boys will be boys’ stuff like drinking at parties – but nothing really, like, criminal, you know? He wouldn’t dare, what with his dad being a lawyer and his mom being, like, State Attorney or something. No way, nah.And as for the ones who didn’t know him all that well, they’ll offer the most perfunctory answers to the FBI’s standard questions so that they can get on with their days.No, I never heard Brett say that he was a communist who wanted to take down the government. Is that all?At some point, a field investigator would have gone door-to-door in Kavanaugh’s childhood neighborhood and randomly knocked on doors to supplement the neighbor referrals made by Kavanaugh’s parents.Oh, yes, Brent! I remember him. Such a nice young man. I heard he went to Princeton or Harvard – one of the Ivy Leagues, anyway. Never had any trouble with him or his family. Such a nice family, the Kevindoughs.And because the background check’s time-frame touches on Kavanaugh’s last year at Georgetown Prep, they get a call from the FBI, too. The Dean of Students and most of the other 1983 faculty have moved on, but the English teacher is still around.Yes, I kind of remember him. I hope you understand that I’ve had a lot of students since then… No, no, nothing really stands out. Maybe the usual, ‘Boys will be boys,’ kinds of things that are typical of that age that we see all the time, but we’re pretty quick to move serious offenders out. We do have our reputation to uphold, you understand[1][1][1][1][2][2][2][2] .At no point has the FBI done a full, conspiracy theory-style corkboard census of all the people Kavanaugh has ever known and might have ever met. They haven’t tracked his every move since birth. They haven’t taken a random sample of persons born between 1960 and 1970 who might have lived in Bethesda, Maryland, in the 1980s. They haven’t sent investigators out to interview every contemporary graduate of every school in the Independent Schools League. They haven’t interviewed everyone who went to Yale with him.No, the FBI has done standard, due diligence in getting a large enough cross-section of Kavanaugh’s closest associates and potential criminal history to fill out their report. With no serious findings, they clear Kavanaugh for his clerkship.And then his file sits for eight years until he’s tapped to serve in President George W. Bush’s White House. The new investigative team goes over the old notes to pick up some leads – but a lot of their focus will be on filling in the space between 1993 and 2001. Is he still a ‘Boy Scout,’ as a one-time associate claimed (the investigation dryly notes that the FBI couldn’t find any records of Mr Kavanaugh having spent any time in the Boy Scouts of America)?New friends and neighbors and a few ex-girlfriends come into the mix, but most of the referees come from a high profile law firm and colleagues from former Independent Counsel Ken Starr’s office. Nothing suggests to the FBI that they need to revisit anything from Kavanaugh’s high school days.New report filed: nothing more to see here.And so Kavanaugh’s background file fills up with additional notes from interviews with contemporary acquaintances as he moves into higher positions. But from 2001, the national security apparatus explodes, and literally millions of Americans are up for security clearances and background checks at all levels. Kavanaugh gets priority as a top-level appointee, but investigators are under intense pressure to close things quickly so they can attack the backlog.If nothing glaring shows up – and, for Kavanaugh, it never does – they update his file and move on. No investigator goes back to his friends at Georgetown Prep and Yale to ask questions – not unless any of those relationships remains significant; and even then, they’re most interested in Kavanaugh’s recent past.Nah, he’s still a Boy Scout. Good husband, good father. Kinda boring, really. I don’t know too much about his private life, though. His job is so crazy, I never really see him.Finally, Kavanaugh gets to his confirmation hearing for the D.C. Circuit Court of Appeals. None of the senators on the Judiciary Committee cares about his personal background. It’s 2006, and the parties are still reeling from last year’s fight over judicial nominations that almost blew up the Senate.Sure, the committee’s staff parse the FBI’s file containing the details and findings of the previous background checks, but that’s not what interests them – and certainly nothing from his time at Prep or Yale. They pretty much assume he’s got a clean personal history.But what the Senate staff are most keen to find are partisan ammunition on his time going back to his days with Ken Starr; and, in the end, Kavanaugh’s confirmation was as much a partisan showing as any other’s. Nobody was digging into his past for anything except that could be used to support the party line.So why didn’t anything like the allegations made by Christine Blasey Ford and Deborah Ramirez come out in the FBI’s previous checks?Because while the FBI does a thorough job vetting people – it is, after all, their job – there’s no human way that they’re going to get to everyone who knows every intimate detail of a person’s life; and unless any untoward behavior in their past resulted in a police record, the FBI is going to be starting with blind spots.People’s close associates will almost always vouch for them – either because they honestly don’t know what’s been done without their knowledge, or to avoid implicating themselves if they’re afraid of consequences. And even though the FBI does its best to go beyond the universe of contacts who would be expected to give a good reference – because they’re not idiots – the more degrees of separation they introduce, the less likely the person they’re interviewing is going to have any relevant information. Eventually, they have to draw the line on what’s a reasonable investigation. They only have so much time and so many resources.It’s becoming harder for teenagers these days to bury bad behavior in their past, but it wasn’t all that difficult with a few good friends and references in the bygone days before social media. And even if a few stories might have surfaced to the FBI, well, “Boys will be boys” culture was very much alive and well – and, again, barring any obvious criminal activity or allegations, it’s doubtful an investigator would have been inclined to follow up.And as time went on, those days became less relevant to the FBI and Kavanaugh’s growing file, even if they never stopped being relevant for Dr. Ford, Ms Ramirez, if not others.My e-mail of moments ago with Mike Davis, Chief Counsel for Nominations for U.S. Senate Committee on the Judiciary.
