They haven’t sent investigators out to interview every contemporary graduate of every school in the Independent Schools League. They haven’t interviewed everyone who went to Yale with him.No, the FBI has done standard, due diligence in getting a large enough cross-section of Kavanaugh’s closest associates and potential criminal history to fill out their report. None of the senators on the Judiciary Committee cares about his personal background. It’s 2006, and the parties are still reeling from last year’s fight over judicial nominations that almost blew up the Senate.Sure, the committee’s staff parse the FBI’s file containing the details and findings of the previous background checks, but that’s not what interests them – and certainly nothing from his time at Prep or Yale. They pretty much assume he’s got a clean personal history.But what the Senate staff are most keen to find are partisan ammunition on his time going back to his days with Ken Starr; and, in the end, Kavanaugh’s confirmation was as much a partisan showing as any other’s. Nobody was digging into his past for anything except that could be used to support the party line.So why didn’t anything like the allegations made by Christine Blasey Ford and Deborah Ramirez come out in the FBI’s previous checks?Because while the FBI does a thorough job vetting people – it is, after all, their job – there’s no human way that they’re going to get to everyone who knows every intimate detail of a person’s life; and unless any untoward behavior in their past resulted in a police record, the FBI is going to be starting with blind spots.People’s close associates will almost always vouch for them – either because they honestly don’t know what’s been done without their knowledge, or to avoid implicating themselves if they’re afraid of consequences. And even though the FBI does its best to go beyond the universe of contacts who would be expected to give a good reference – because they’re not idiots – the more degrees of separation they introduce, the less likely the person they’re interviewing is going to have any relevant information. Eventually, they have to draw the line on what’s a reasonable investigation. They only have so much time and so many resources.It’s becoming harder for teenagers these days to bury bad behavior in their past, but it wasn’t all that difficult with a few good friends and references in the bygone days before social media.
