PDF Editor FAQ

What is the most passive aggressive behavior an in-law has demonstrated to you?

I was in the middle of a divorce with a man who was in prison. He was facing over 30 years and received 10. His crime was more or less cheating on me with a minor. As soon as I announced the divorce my mother in law called everyday screaming at me why was I divorcing her son and that she didn’t understand. Then came the status hearings before the divorce. The court found out that I was left, without an income, literally in the middle of the night. My ex had a bank account in his name only. The bank didn’t acknowledge community property, I was granted $17k from a joint account. I also informed the court that I was moving to another state. My husband’s sole name was on all the accounts and I couldn’t cancel any of them. I was granted a POA (Power of Attorney) to be drawn up by my husband’s attorney. She never did. And…instead…gave the power of attorney to my mother in law who drained the account after I took my part. In that hearing I was also granted all the property in the house and the cars. My mother in law wanted the car that they gave us back. I claimed undue hardship. Then she called my attorney everyday to get “her son’s possessions”. So I packed what I wanted up. My attorney gave me grief about my mother in law. I gave a date (as my attorney required) as to when they could pick things I didn’t want up. I was told that if they didn’t show then I could do whatever I wanted with the stuff. They never showed. Then, one day, weeks after they showed on my door step. I called the police. So then they made a stink about coming back again…two days before I had to move out of the house I rented. I made a deal that she would have to take everything in the three car garage. She did not. I was left with a packed garage. So then it was time for me to move. I forwarded all the mail, including his, to my new address 2000 miles away. There was some important mail that I was waiting for. She comes in and forwards all his mail to her when I was still married to him. She has the nerve to reforward opened mail that was his bills. Now I’m getting another nasty call from my attorney. Why am I not closing the bills out. I tell her that I’ve already tried. This was the point of the POA that I was never given. And now his attorney is no longer practicing. Because of this my divorce hearing was continued for two years. She didn’t tell he son that he no longer had an attorney. The divorce was almost continued for another year. Oh, and did I mention that my mother in law got my ex the attorney and used the money from the bank account to pay for it (and the move). He was supposed to sign the divorce papers and leave me with everything, but that’s okay I hit him with a no contact order. Now, neither he or a representative from his family acting on his behalf are allowed to contact me. The worse thing about this is that this woman has done the same thing to his two other ex wives.

Who gets the power of attorney? The siblings of the deceased or the children of the deceased.

No one gets the power of attorney for a deceased person. Powers of attorney are used when someone is alive so that other people can act on behalf of a living person. When a person dies, generally, power of attorney dies with them.If you are asking about the person who has the power to manage the estate upon someone’s death, the will should dictate the executor. If there is no executor, and/or no will, then the estate has to go through probate. Any adult who falls under the requirements of intestacy of the jurisdiction can go to court to get things moving. Then the court will appoint someone to act as executor.Generally, under the laws of intestacy, spouse and children take. Siblings often only take if there are no spouse and/or children. If the children are minors, then their guardians can act on their behalf. If you are in this situation, it would do you well to consult with an attorney.

When does a power of attorney expire?

General powers of attorney expire in the following three ways:when the document says it doeswhen the grantor revokes itwhen the grantor diesSome powers of attorney have legal time limits.. such as POA’s granting parenting powers over a minor. In Michigan those expire after 6 months by law.
