Thanks to Charles Schumer, the arbitrary and capricious gun laws of New York have gotten progresssively harsher over the past 30 years. Case in point is the charge of “Criminal Possession of a Weapon 3rd degree.” I could easily write 50 pages just pertaining to this one law, but I will do my best to be concise.It is an automatic prison sentence to be found with a handgun in New York State without a valid NYS Pistol Permit. Permits from other states mean nothing. A restricted permit (ownership, hunting, target) means nothing if it is found in your car not in a secure lockbox with ammo in a seperate lockbox. A NYS Carry Permit means nothing in NYC or Nassau County. There is no exemption for antiques, curios, relics, or black powder guns either. The only exemption applies to current or retired law enforcement officers.You do not need to be carrying the gun on your person. It can be in a suitcase in the trunk of your car. It can be locked in a safe in your own home. If there is a box of ammo near the gun it is considered “loaded” which is an aggravating factor with harsher penalties.If a gun owner dies, any and all handguns must immediately be transfered to someone with a NYS Pistol Permit or removed from the premises by the NYSP. Failure to immediately do this is a felony. The penalty is 3–7 years in prison with a mandatory minimum of 1 year. “Ignorance of the law is no excuse.”Possession automatically equals guilt and plea bargains are not accepted. The only defense is you did not “knowingly” possess it. If a car is pulled over, searched, and a handgun is discovered, all occupants of the car will be charged with felony possession.Once convicted, the only possible way to restore your rights is to apply to the court you were sentenced in. If the court says no, or stonewalls you with no response, there is nothing you can do. The judge cannot be compelled to provide an explanation, it is done at his whim. You cannot request a change of venue, only the sentencing court can restore rights… but if they agree, they usually restore all rights “except the right to possess a firearm or hold public office.”Other felons can apply to the Parole Board for a “Certificate of Good Conduct” to restore their rights… but Schumer insisted that simple possession of an unlicenced handgun be classified as a “Violent Felony Offence” and the Parole Board cannot issue a Certificate for a Violent Felony. Schumer also cut funding to the BATFE office that restored gun rights to eligible ex-offenders, shrieking that it was a “loophole.” You cannot apply for Executive Clemency either because the Governor refuses to issue Pardons and the President can only Pardon federal crimesCompounding this injustice is the fact that it is extraordinarilly difficult simply to complete the application for a NYS Pistol Permit. In addition to filling out multiple forms, you need to make appointments for fingerprints and photos, then submit 5 notarized character references AND a statement of “good cause” why you need the permit. If you write “protection” your application will be refused and the fee will not be refunded.New York is a “may issue” state which means, even if you qualify, a judge may refuse to issue a permit at his whim with no explanation and the refusal cannot be appealed. A restricted permit limited to ownership, hunting, target is difficult enough to get in some counties, and nearly impossible to acquire in NYC. Carry permits are only issued to police, politicians, and the politically connected in many counties. Once issued, a Permit can be revoked at any time “for any good cause” which the judge is not required to disclose. I am aware of 2 cases where permits were revoked simply for writing a letter to the editor of the newspaper critical of local officials.Permits expire every 5 years and must be reapplied for. They are not automatically renewed and can be arbitrarilly denied, whereupon you must immediately turn over or legally transfer every registered handgun or risk police coming to your home with a search warrant to arrest you on felony weapon possession charges.The 2nd Amendment is not recognized in New York State and Charles Schumer is a traitor to the American People he swore an oath to represent.C.
