How do law firms make money?

It depends on what type of case/work the form is doing and whether the firm represents plaintiffs or defendants.Let's take for example personal injury. If the firm represents plaintiffs, depending on the state, it will generally take 1/3 of the settlement or judgement amount. This regardless of how many hours were spent on the case. Some cases could reach a quick settlement others can drag on for years before plaintiffs see any money. If the firm represents defendants in personal injury, medical malpractice or workers compensation, then insurance companies pay the firm billable hours. If the firm handles probate cases, in NY, the firm charges between 3% to 5% of the estate regardless of the hours spent on the case. Similarly, firms doing estate planning generally charge a flat rate for a comprehensive package. The rate ranges from $7,000 to much higher price, depending on the assets being moved. A middle class person can expect an average of $10,000 for a trust, power of attorney, pour-over will, advanced health care directives and health care proxy. In criminal defense cases it depends what kind of charges are being defended. DUI involves some form of retainer (flat fee) and more complex cases could be charged hourly. This also depends on the client. If you're representing El Chapo, be sure you ask for a flat fee in range of 7 figures, no need to nickel and dime.

What does having a mom feel like?

A father's greatest fear:As a single father, I worry about this exact question EVERY DAY? Its 5:33 in the morning in NY right now and I'm up worrying about it now!! This will also probably be a short post because I have to start my morning soon! My son's mother developed and bad heroin addiction after he was born. Is partially my fault…. I was in an accident and I was prescribed strong pain medicine. While I was out of work we fell into serious financial problems, it became very stressful and eventually she had started taking my pain medicine I suppose originally it was a means to escape. I tried to get her help I tried to get her to stop I did everything I could think of but it just got worse. When he was 2 years old it became obvious to me that he was no longer safe in the house with her because her decision-making was just so far gone. So I took the baby I got an apartment and I file for custody. I stayed on as his mother's health care proxy. I put her in rehab two more times after I left, and I went to her NA meetings to check on her and make sure she was there during the outpatient program portions. I remember nights when she left and started driving and I had no idea where she was going and my anger and my curiosity forced me to follow her for about 20 minutes thinking I was being led to a drug dealer's house. Thoughts were running through my head about what I might do if I caught her buying drugs this far from where she lived after everything we went through. Lovely it turned out she was going to a second meeting that night that just happened to be a little bit further away than the usual and a meeting location. But it showed me what a terrible mental toll the whole thing and taking on me. Shortly after that she relapsed and when she relapsed she relapsed with a guy that was a heroin addict. That was like officially the end of the person that I had known before. That's when she was totally gone. The only person left was the heroin addict that lived in her body. When the custody trial dates arrived she just never showed up. I went four times she showed up never once. At the fifth trial date the court Magistrate called her cell phone from the courtroom and demanded to know why she was not in court. My son's mother just hung up on her. The magistrate said she's seen this type of behavior plenty of times and she felt there was no need to drag it on any longer. So I was awarded sole custody. That was over 5 years ago. My son has never seen his mother since. Actually she stop by my house one time shortly after I got custody she didn't stay long but she promised she'd be back to see him. Her walking out the door is the last thing I remember of her. He no longer remembers her at all. And this is where my fear sets in…What's it like to have a mom??How do we even quantify the significance of that question? Right now my son is 7 years old and he's the happiest kid in the entire world and he says all the time he doesn't have a mom he has a daddy and he has his grandparents and that's all he needs. Him being so happy and healthy and kind sweet gentle and generous singing dancing laughing developing a little bit of a wise-ass personality that is borderline inappropriate but 100% hysterical... These are amazing things. As a father it's a privilege to see my son growing to be so happy and functional. But I know there will come a time when he's going to want to know why doesn't he have a mother? I'm not going to say she's dead I'm not going to lie to him like that. It's going to be a confusing and difficult time for him. Also there will be milestones in my son's life that a mother should be there for and he won't have one there. That breaks my heart. And breaks my heart because he deserves it. He deserves a Mom. He deserves for every mom in the world to get to know him and to love him because he's that fucking awesome. And yet he doesn't even get to show his own mom how incredible he is. I'm not a spiteful man and I forgive her... But when I think of this I just have to say... Fuck her. Excuse my language I don't mean to be offencive but there is nothing else that quantifies what she deserves to be said other than fuck her fucker right to hell. Someday I'm sure she'll come around maybe when he's successful or maybe when she's just so strung out and she thinks he's old enough to have a little bit of cash on them but I'll never let her around him again not unless I know she's clean and sober. She will never be alone with him. She can visit she can write she can call she can send gifts she can send I love yous or even I OWE YOUS… BUT YOU'LL NEVER BE ALONE WITH HIM OUTSIDE OF MY SUPERVISION.Another thing that scares meGod knows I love my son to death. God knows I'm doing everything in my power to be a good dad as well as a good mom. But in all honesty I am not very good at this. I am not complaining! I would never trade my son for anything in the world! I am simply admitting that he deserves more than me… I am not the well-rounded parent that the people in my upscale expensive neighborhood are. I made tons of mistakes. I forget things all the time when it comes to packing his backpack putting something in his lunch bag…. I can only imagine what the women on the PTA think of me. I am also never involved in extracurricular activities because I have to focus on supporting this family. They don't know that. In their world everyone's married driving Mercedes SUVs living in huge houses on the water. I moved here knowing I be out of place sticking out like a sore thumb but that was a good school district for my son so I took the shot on the chin to give him the better education. Again I am not complaining but this all comes back to what does it mean to have a mom? Why doesn't he have someone taking him to Book Fairs? Why doesn't he have someone taking part in the bake sales? Why is he spending weekends at my father's house where there are no kids is age instead of setting up play dates with his classmates and their families? But one thing is for certain. My son is a man's man. He is a throwback to a Time when men handle their business, when they knew what a socket wrench was, when they were not afraid to defend themselves or stand up for Injustice when they saw it happening right in front of them.My son is a little dude. There is no other way to describe him. He's just a dude. Not a sweet little boy not a darling little kid... He's just a dude. Likes to hang out in boxer shorts, sneak sips of milk outta the carton, loves cold pizza, quick with a joke or a light of your smoke… hes the byproduct of growing up with pure testosterone and I wouldn't want him any other way.

Why does it cost so much to protect your assets from Medicaid?

It's only expensive if you’re of penny wise dime fool mentallity. When you compare the value of your assets saved from the government with the cost of proper estate planning (an irrevocable trust and ancillary documents such as pour-over-will, power of attorney, health care proxy and advanced health care directives), then you will see that the cost of protecting your assets is less than the a month’s cost of a nursing home. The typical Medicaid planning costs around $10,000 in NY, as a one time expense. The cost of nursing home in NY is $16,000/month. You do the math. Medicaid will only pay around $9,000/month for nursing home. However, if you want to protect your assets you have to act fast because there is a 5 years look back. Meaning you would be liable for medical care cost for up to the value of any assets you moved from under your name. You can become qualified for Medicaid home health aide within 30 days. But you could do emergency planning if you were caught unprepared by an illness. Worst case scenario you will only end up paying the Medicaid rate not the market rate for nursing homes. That way you can still save a considerable portion of your assets. There are some very clever and knowledgeable estate planning lawyers out there. Find one that is heading the local bar association elder law committee and/or is a law school professor. Such a lawyer is usually teaching other lawyers how to handle estate planning through continuing legal education. Their fees are not any higher than that of an average estate planning lawyer but the results could be considerable better because they are the best in the industry.
