The dirtiest fine print I've seen in a contract is not printed in the contract per se & that is the Uniformed Services Former Spouse Protection Act (USFSPA). The USFSPA enables state family courts to treat a service member’s military retainer/retirement pay (MRP) as community property in a divorce & entitles a former military spouse up to 50% (and in some circumstances 65%) of a service member’s MRP.Service member’s sign their contract with the U.S. Government & take the oath to support and defend the Constitution of the United States against all enemies, foreign and domestic. Should a member choose the path of a military career & serve our nation for a minimum of 20 years in order to earn a lifetime of retirement pay, they are unaware that if they marry & divorce during their 20+ years of active duty service, regardless of the length of marriage, their former spouse is entitled to up to 50% of their retirement pay.This is a lifetime entitlement & does not terminate until either the member dies or the former spouse dies, whichever occurs first.Many service members don’t learn of this Act until they are well into their divorce proceedings. Nor are they aware that they can negotiate the length of time, or conditions for continued payments to their former spouses. As such, many former spouses receive their entitlement regardless of remarriage.It’s not uncommon for a former spouse to marry a one member for 10–15 years, divorce & be awarded 50% of the member’s MRP. The same former spouse then marries another member for 10+ years, divorces member #2 & is awarded 50% of member #2’s MRP essentially earning 100% of MRP without every serving a day in the military.Furthermore, this Act protects the former spouse’s entitlement from offset or garnishment for any legal obligation including, child support owed to the member by the former spouse.My man is a retired 1st Sgt of the U.S. Marine Corps (22 years). His ex receives 41% of his MRP. She owes him $10,000+ for child support but, he can’t touch her entitlement to his MRP to get paid the child support she owes him because, her entitlement is protected under USFSPA. Only the retired member’s MRP can be garnished to pay the former spouse for child support and/or alimony.IMO, that’s a pretty dirty deal for service members. They should know about this Act in their contracts when they decide to join.
