Unless you want to read the hairiest anti Airbnb rant ever? Don’t bother with this, it’s too long.I don’t know what tricky scheme means here. Business is in many forms tricky and schemelike so Airbnb is just another business. It has positives and negatives like a Hershey bar or a Ford F150.Airbnb is not on my list of favorites for some basic reasons. I will mention a pro argument that is quite clear, the majority of revenue from the transaction goes to the homeowner as opposed to Hilton or whomever. Important to keep in mind, that is not why Airbnb was founded nor why they stay in business. Thus, I will refrain from deifying them in this matter.An Uber/Lyft driver is conducting a commercial enterprise with their personal car. The vast majority and I mean vast majority of drivers do not maintain commercial insurance. It is, in the eyes of commercial operators, “mickey mouse” and it is. State and federal highway transportation regulators require commercial insurance. Uber/Lyft has “magical” on and off insurance that only covers the actual ride. Guess what? When a 20,000 pound Peterbilt operated by JB Hunt trucking company is “returning” home “empty”, from dropping a load? They have full federally mandated insurance which means if there is an accident and someone gets hurt? Everything and everybody is covered.Uber/Lyft have a lot of lawyers and powerful money people behind them so, when regulators fuss? The lawyers just paper them and the marketing people use every trick they’ve got to make them look like assholes.Airbnb is exactly the same. They decided to start a hotel chain and they did. In their case, just like Uber/Lyft they have “app users” whom are conducting a commercial business.None of those private residences are commercially zoned. None of them. Every Airbnb lawyer in the world can make me look like an idiot, but, NOT ONE Airbnb is correctly zoned by any town effing anywhere ever. In any court of law anywhere I win until the town re zones which they can’t do because it is a NEIGHBORHOOD. You know? Where people live in their houses or condos or apartments or wherever, but now? It’s a commercial area. So, I take a page out of the Airbnb book and I buy a house in that neighborhood and start selling pizza and doing deliveries. “No, no, no. You can’t do that. Not zoned for that. Can’t get a license.” Oh, so it’s different?So, they‘re all illegal hotels…whoop de do.There are 35,000 Airbnb rooms in Manhattan. Then there are 110,000 legal hotel rooms offered by about 300 hotels. You see, the people in tech land are smarter than you. They just make an app that turns your apartment into an illegal hotel and they get a cut of every room sale in the equivalent of 100 hotels in New York City. I guess THEY are the “distant corporation” now.“All of those empty rooms were being wasted. It was unused capacity…” That was the Soviet Union in 1949 except Airbnb throws in an $80 bribe.So, I have my three bedroom ranch a block away from the harbor and my neighbors on both sides of my $589,000 house are running hotels. So, I go to the town to complain and I’m a jerk?“But there are ordinances in towns that permit renting out rooms to transients part time.”These laws were from 1932 during the depression.Everybody hates me for this position because they are making money running a hotel in a residential area. Hate me all you want. You need to go to your town and get rezoned.I owned restaurants. Do you know what a “HAACP” is? You are serving your guests a muffin and coffee in the morning, where’s your license? What if you kill them with your breakfast? You got commercial insurance for that? What happens when the place burns down? You think your homeowner’s policy has that one covered? When the family of the injured guest sues you and Airbnb and the guy who built the house and the town that allowed the “improperly configured” dwelling to operate commercially without fire and safety standards? How’s your bank going to feel about this hotel thing? Do you know what a covenant is? Where in that mortgage document is the hotel thing?“It’s ok cuz Airbnb says so.”Airbnb built 100 hotels in New York City without pulling one permit. Talking to one architect or spending a nickel on commercial insurance because their hotels are all illegal. None of them have fire protection. None of them offer breakfast from an inspected or licensed facility and there are 10,000 illegal hotel operators who hate me right now and are going to tell me that I’m wrong except for this.That ordinance that says you can rent a room here or there? Those are rooming houses…not effing hotels with Randy and Dierdre staying on Friday night and then Larry and Roxanne on Saturday and the Gullicksons next weekend. That’s a hotel. The “renter” is familiar with the structure. Authorities turn a blind eye.It does not allow you to operate a hotel in your neighborhood unless your neighborhood is zoned for it and it doesn’t allow you to operate a hotel in your residence unless it meets safety codes and it doesn’t permit you to serve a cup of coffee unless you washed the cup with the correct procedure including a 180 degree sanitizing rinse because that is the law which, you don’t want to observe in your illegal hotel.If you’re “occasional room rental ordnance” gets hung out to dry in court with four injury lawyers going over every illegal hotel record you have? How is it going to go? You “knew” your house was not to commercial code and Airbnb is not a license.I had a restaurant chair in my dining room 14 inches from the emergency exit. If I hadn’t removed it, the fire chief, who was telling me to move it, would have closed me down until I did. Airbnb has it’s own set of rules, until some folks get killed.Long ago, there was a company called the Lorillard corporation. Through extensive research in the 1950’s and 1960’s they learned that their product killed people at an alarming rate. It even killed the people who were in the same room as the people using the product at an equally alarming rate. Tobacco companies have killed 50M people in the last century because it was their job to “make money.” It was their job to hire lawyers to paper the people and organizations who were trying to expose this ongoing murder and it was their job to hire shills to go out and make anti tobacco leaders and groups look like assholes.You see, if it’s all about making money? Then they will just kill all of us because money making decisions, if not balanced with morality, just cut down every tree that ever lived, sold cigarettes to 16 year olds, painted the shit out of every house everywhere with lead paint, stuffed all of those same houses full of asbestos insulation that they knew made people young and old sick, formulated gasoline with lead because it “made the engine run better” but, it killed more people.See the movie “Erin Brockovich.” The gas company was exterminating an entire village full of people because it would cost “too much money” to properly clean up the hexavalent chromium that the people were drinking, washing their fruits and vegetable with and bathing in ever GD day. They knocked off a lot of them until the biggest fire breathing jerk in the world showed up and went bat shit on them for three years and beat Pacific Gas and Electric for $333M in damages.Airbnb isn’t some dangerous chemical. It’s just renting a room to some nice folks once in a while. That’s correct. You aren’t doing anything wrong. You aren’t hurting anyone, you just need to get re zoned, fire inspected, change your mortgage, buy hotel insurance, get your kitchen to spec, take the food handler’s course, move the pets somewhere or better yet, change the health code in your town, make sure that bedding is spec too and that hammock on the front porch. It’s blocking one of the windows that would be used to escape a fire.In 40 years of running businesses if I haven’t seen it I’ve heard about it. I’ve been to the hearings the depositions, the health, structural and fire inspections. They are all there to keep the “money makers” from killing us all.Your Boeing 747 would be driven by one hungover guy who is behind on his sleep and has lousy vision instead of three sharpies with perfect white shirts and 7,000 hours of training if it weren’t for laws written after bunches of people got killed. What happens if, the life boats on the side where the iceberg is just wipes them the f out and you can’t use them? The water is 34 degrees which means the swimmers are dead in 15 minutes? In the 50’s, they figured out that in a head on collision the engine was lifting and entering the passenger compartment and killing the person sitting in the middle seat. They fixed it, because GM wasn’t going to because, it would…cost money.When some idiot leaves the candle burning in the upstairs bedroom of the illegal hotel and then goes to sleep and it starts a fire and your house which is built to residential code starts to burn, how is anyone going to get to the stairs to get the hell out? The Ramada Inn has stairs that won’t be full of smoke and correct emergency lighting. The firemen know what to do and where to go at the legal hotel. None of the walls or floors or any structural detail in the illegal hotel is designed for fire suppression or to assist a guest, unfamiliar with the building in the dark in a fire because it’s an illegal hotel. When the guest is killed their family’s lawyer is going to sue the ever living shit out of everybody looking for a settlement.In court:“Was your residence built to fire code XYZ?”“No.”“Did you have approved emergency lighting?”“No”“Did emergency services, on your dinky, little residential lane have access to get their trucks to the four guests trapped in the fire at your house?”“Did the fire chief have any GD idea where the bedrooms were located so they could help them?”(True story) The guy has a 35 foot boat. He gives rides to the tourists in the summer. It’s ok, he’s just trying to make some money and make ends meet. He’s a nice guy and has been doing it for years. Did I tell you he wasn’t coast Guard inspected or licensed? How about life jackets and passenger capacities. Did he have a mate with him to assist on the trip? This “guy” got the people a half mile out and his overloaded boat rolled. He killed 8 people including little kids that day. Because he’s just trying to make a little money.Big hotels have expensive, properly designed systems in place for the guests safety because, a hundred years ago? The idiot hotel operators weren’t regulated because they hadn’t killed enough people yet. Don’t worry, building codes that you don’t observe are in place because 1000’s of people died in fires in unsafe structures. You know? A house that isn’t correctly configured for a room guest waking up in the middle of the night in a fire. They don’t know what the hell to do. They are in a strange place.Professional conduct is regulated throughout society. Laws protect us from the litany of “companies and individuals” who are “trying to make money.”(True story)The health inspector popped into the restaurant down the street from mine one morning. The owner of this place and his staff were cutting up a deer he’d hit with his car the night before. The health inspector closed him down…thank God. You can serve venison at home all you want. You can’t serve uninspected and prepared meat in a licensed restaurant because there are laws that prevent idiots, whom are trying to make money, from killing us all.In 2003, in a town just like yours, a club was putting on a rock show. The show started, pyrotechnics were shot off by the band and the place caught on fire. One hundred people were killed and 230 injured.The structure was over capacity.The fire suppression/control system was not legal for the application.The emergency exits were illegal.The emergency lighting was ineffective.By law the facility should have had a sprinkler system.The facility was not equipped to manage pyrotechnical displays by bands.The owners did not have correct insurance, thus, 4 deceased employees’ families got nothing.The owners were each charged with 200 counts of involuntary manslaughter—two per death, because they were indicted under two separate theories of the crime: criminal-negligence manslaughter (resulting from a legal act in which the accused ignores the risks to others and someone is killed) and misdemeanor manslaughter (resulting from a petty crime that causes a death).The owners knew that this building was not to code. They knew their insurance was mickey mouse, but, they loaded it up anyway and killed a hundred people and maimed a couple hundred more.
