When you make certain huge deposits into an account, a money laundering register is opened for you. Officials can trace you to your address and you can be made to cough up your tax liabilities. It is already happening. Also, they are not preparing final accounts. No annual general meeting and you have a budget surplus (this is used instead of the word “profit") in excess of 100 million naira. Do you think restructuring Nigeria is the way forward?

Yes. fiscal restructuring is the best option.There are a lot of anomalies in Nigeria. But before I say more, let me reproduce sections 162 (1) & (2) of the 1999 constitution.(1) “The Federation shall maintain a special account to be called “the Federation Account” into which shall be paid all revenues collected by the government of the Federation, except the proceeds from the personal income tax of the personnel of the armed forces of the federation, the Nigerian Police Force, the Ministry or department of government charged with responsibility for Foreign Affairs and the residents of the Federal Capital Territory Abuja.(2) The President, upon the receipt of advice from the Revenue Mobilization and Fiscal Commission. Shall table before the National Assembly proposals for revenue allocation from the Federation Account, and in determining the formula, the National Assembly shall take into account, the allocation principles especially those of population, equality of states; internal revenue generation, land mass, terrain as well as population density:Provided that the principle of derivation shall be constantly reflected in any approved formula as being not less than thirteen percent of the revenue accruing to the Federation Account directly from any natural resources.It will be pontification to emphasize on the mandatory nature of the word “shall” as expressed in the Constitution. Information from the Accountant-General’s Office shows the current fiscal model implemented by the RMAFC as follows; Population 30%, equality of state and local government 40%, land mass and terrain 10%, school enrollment (education) 4%, health 3%, territorial spread of water 3% and internal generated revenue 10%. It is interesting to note that population and equality of state and local government alone accounts for 70% of the federation account.The current RMAFC formula is a glaring and continuous breach of the Nigerian constitution 1999 (as amended). Firstly, the Constitution stipulates ‘equality of states’ not ‘equality of states and local governments’. What this means is, revenue should be shared equally among states irrespective of how many local governments they have. A lot of states are continuously being cheated as a result of this lopsided formula because states with more local governments take a huge chunk of the revenue from the federation account. For example, Bayelsa state with eight local governments takes 8 portions compared to the 44 portions of Kano state.Secondly, population density which is a mandatory stipulation of the Nigerian constitution is not included in the allocation formula. This is also in breach of the 1999 Constitution. It is mind boggling especially when considering that population density is a function of population and landmass which gives the number of people living per square kilometer.For example, a highly populated state like Lagos with a landmass of 3, 496km2 and a population of 9, 013, 534 has a density of 2, 578 persons living per square kilometer. While a place like Niger state with a population of 3, 950, 249 and landmass of 74, 109km has a density of 54 people per square kilometer.It is incomparable, the rate of infrastructural wear and tear a state like Lagos will be confronted with in comparism to Niger state – or any other state for that matter, with a large landmass and little population. If landmass and terrain alongside population makes up 40%, it is only logical that population density makes up 20% of the revenue allocation formula.The fiscal model currently implemented is disproportionately weighted to favour “certain” geographical parts of the country. It is this inequality and injustice amongst many others that has given spark to the fire of self-determination currently engulfing the country. The best solution is for states to have autonomy over their own resources while contributing a percentage to the center. And this is the way a true federal system of government works.This percentage will be disbursed based on a revenue sharing formula that will be equitable – some of which would also be used to address essential institutions of a leaner, fitter and more efficient federal government. This way, every state will struggle hard in their respective regions to develop from within, whatever economic resource(s) they have – and at the end of the day, can honourably come out as recipients of the national distributable pool.What we have presently is unobtainable and unsustainable in the long term. It is the bane of laziness and unproductivity. There is no state in Nigeria that is not economically viable and it is high time we recognize the finite quality (or quantity) of oil. Some of the untapped commodities and natural resources located in the different parts of the country may even become more viable than oil in the future. This is why there must be a synchronicity of the diversification and restructuring process.The restructuring process could be staggered and carried out in a graduated fashion so that states are not suddenly left out in the cold. If states are given the autonomy over their resources, there will be a chain reaction. Firstly, political party manifestos will matter. Visionary leaders with proven track record in business or public service who have a concrete blueprint of generating internal revenue will be elected. Jobs will be created. The government will be closer and more accountable to the people. And corruption will be reduced.The nation does not need to be divided into parts. Our differences and diversity should be the key ingredients to a more cohesive and united Nigeria. Restructuring is no longer a choice amongst many alternatives. It is the only option for the survival of our dear nation.
