California Apartment Association Rental Agreement: Fill & Download for Free

Both tenant and landlord should each have their own copy of the rental agreement. If one of them cannot find their own copy, then that person should just ask the other one for a copy. Those are the only two parties that are likely to have or be interested in such a document stating the terms between the two parties. There usually is no third party that would be interested in or would hold such a document for the benefit of landlord and tenant. This is an important document and it should be stored in a safe, readily accessible place by both landlord and tenant.If the question instead is asking where one can get a blank copy of a standard rental agreement, they are available online from rental property associations such as the American Apartment Owners Association which covers all states in the US, or from the California Apartment Association for California only. Forms may also be available from local realtors or stationery supply stores. Different regions have different standard forms because rules and regulations governing rental property agreements vary by region and state in the US.

However that does not stop people from behaving as though there is a difference.I have seen many apartment association forms that choose to entitle their month-to-month forms “Rental Agreement” and that choose to entitle their form for a longer tenancy as a “Lease”. Similarly many brokers and others ( excluding lawyers) may refer to these documents using the same distinction.Even so there is no legal difference in the California codes between the real property tenancy created by an “agreement” and one created by a “lease”. In both cases the agreement is a lease and the term is a lease term.
