PDF Editor FAQ

As a family law lawyer have you ever run a case you seemed to be ripping your hair out over through the whole case? What did you come away with as an insight?

I have run into this problem as an attorney and as a mediator. In a mediation where I served as the mediator approx. 3 years ago, the parties came to me for several sessions. The wife had a great attorney. She fired him. She was an engineer and said that she was smarter than anyone else (including the judge) and that she’d never hire an attorney again. Unfortunately, she had a huge ego - but no knowledge of Texas law or courtroom procedures. She also wanted to micro-manage the father’s time with the child 100% - even to insisting that ONLY she was capable of combing the child’s hair - the child was approx. 10 years old. Dad was also an engineer and capable of learning how to do the daughter’s hair.It was the only time in my 10 year mediation career that I wrote a 6 page letter to the judge (with copies to the parties and husband’s attorney) that went over each of her complaints one by one. She had over 40 issues for me to address! The judge totally agreed with me and entered the Final Decree of Divorce per the Mediated Settlement Agreement. At the end, the husband and his attorney called me to thank me for my professionalism in dealing with her “unusual” and “demanding” behavior. As an attorney, I eventually learned that if a client started to behave badly to just withdraw and walk away.I lost sleep many times over child custody cases - in many cases I cared more about the children than either parent. Their “bad” behavior broke my heart in regard to how it impacted the children.

What happens if my husband files for divorce and I do not respond to the petition at all nor go to the court?

In Texas, if you were served properly and don’t respond then the judge will just assume that you don’t care. And husband can put anything in the final decree of divorce that he wants. For example, he could put it in that you owe him $1 million payable each month at $1,000/month until paid in full.If you have minor children then he can put that he will have custody of the children, you have no access to the children and you pay him child support. As you can see, it can be dangerous to do nothing.I humbly suggest that you talk to a lawyer in your are.

Do I need a lawyer for divorce of just a 3-year marriage with no assets or debt, just a child together?

In Texas where I live, you do not need an attorney if you have a child. BUT I would not do anything without hiring a family law attorney.Child custody, child support, parental rights and duties, visitation, etc. is a big deal. AND once it is finished (final decree of divorce) then modifying it later is not easy. So if you sign a crummy Final Decree of Divorce and you later regret it, expect to pay several thousand dollars to hire an attorney to try to modify it. And in Texas, unless it’s an emergency, you can only go to court once a year max. In reality, divorce and child custody is so expensive that most people cannot afford to file a modification often. In Texas I recommend www.texas law Drug and Alcohol Abuse Rehab, Resources, and Support | Help.org for people to learn about TX divorce and custody. In the US, each state controls their own divorces and their own rules. So you need to look for information and an attorney in your state.I’m an attorney and I would not ever represent myself in court. I always hire an attorney to help me then I keep my mouth shut. There is an old saying - only a fool would represent themselves in court. So please don’t be a fool.
