Clearly Sheriff Behan and the Earp’s were at odds. Moreover, the Earp’s were probably as “corrupt” as any other participants in the town. Virgil Earp served as both the Tombstone City and Deputy U.S. Marshal. Wyatt Earp was always looking for a quick way to make money — brothels, saloons, prostitutes, protection schemes, etc. Behan was also of the same ilk.The Earp’s clashed with an informal group of outlaws known as the "Cowboys." Wyatt, Virgil, and younger brother Morgan (who was later assassinated) held various law-enforcement positions, which put them in conflict with Tom and Frank McLaury, and Ike and Billy Clanton, who threatened to kill the Earp’s on several occasions. Following the death of Newton “Old Man” Clanton, Curly Bill Brocius became the primary leader of a loose-knit Cowboy gang. The outlaw acts committed by them were rarely well planned or coordinated. For many years, the Clanton’s had been suspected of rustling Mexican cattle back over the border for sale in Arizona and New Mexico. It was at this time his cattle empire became known as "The Clanton Gang". Old Man Clanton hired many good and not so good ranch hands to work along side his sons Ike, Phin, and Billy. Among the workers were names like, Johnny Ringo, "Curly Bill" Brocius, Peter Spencer, Pony Diehl, and the McLaury brothers.Wyatt Earp and Johnny Behan applied for the same new position of Cochise County sheriff, which paid the office holder 10% of the fees and taxes collected, as did the Pima County sheriff job. Earp thought that he had a good chance to win, but Behan had more political save. Earp later testified that he and Behan had made a deal. He said that Behan and he agreed that, if Earp withdrew his candidacy, Behan would appoint him as undersheriff. Behan received the appointment, but he did not keep his end of the bargain and instead chose another man as undersheriff. Ike Clanton and Johnny Ringo had served as election officials.Shortly thereafter, Earp learned that Ike and Billy Clanton had one of his prize horses, which had been stolen more than a year before. Earp and DocHolliday rode to the Clanton ranch to recover the horse and overtook Behan along the way, who was also heading to the ranch to serve an electioneering subpoena on Ike Clanton. Earp later testified that Billy Clanton gave up the horse when Earp arrived at the ranch. According to Behan's testimony, however, Earp had told the Clanton’s that Behan was on his way to arrest them for horse theft. The incident embarrassed the Clanton’s and Behan, and Behan later testified that he did not want to work with Earp.The Gunfight at the O.K. Corral made legends of Wyatt Earp, Doc Holliday, and the Outlaw Cowboy gang, but they were relatively minor figures before that conflict ensued. After the Gunfight at the O.K. Corral, Behan testified at length against the Earp’s. He supported the Cowboy’s statements that they had raised their hands and offered no resistance, and that the Earp’s and Doc Holliday had murdered three cowboys. Three defense witnesses gave key evidence that discredited Behan's testimony. After the Earp’s were exonerated largely because they had been formed as a legal Federal posse. The Earp’s left Tombstone under a cloud of suspicion, however.Behan was ultimately arrested for taking graft and later failed to win re-election as sheriff. An investigation found that Behan had somehow set aside $5,000 in funds while he was sheriff from unknown sources.
