This is a very legitimate question! As the OP states, no one (not even judges and states attorneys) know all the laws. In our training we get regular updates on new laws and changes to old laws, and my department used to subscribe to the Illinois Law Review, which was a monthly pamphlet detailing SCOTUS and Illinois Supreme Court rulings, and how they applied to our street activities.But even with that, there were sometimes gray areas that caused us to pause. And if we had the time and opportunity to do so, we would do just that.Most crimes in progress that are serious are pretty cut and dry. We may not be able to cite the statute number (like they do on TV), but we know a crime when we see one. It's kinda like beauty. It's easier with experience.But when an officer is not sure, he/she asks. He asks colleagues first, then supervisors, and it goes up the chain. We had access to the statute books on the street, and consulted them often. Detectives usually have the luxury of time when they investigate lesser encountered crimes, and ultimately the states attorney decides if the elements are met to charge with specific crimes.

About 20 years ago. I was ticketed for speeding in a school zone, in a small town in Illinois. There were no children visible at the time - the Illinois law says that the 20 mph limit applies when children are present and near enough to the road to be endangered by traffic.I did some research, pled not guilty, and showed up in county traffic court for the trial, prepared with a defense, but hoping the cop wouldn’t show up. But he did. The District Attorney presented the state’s case, asked the cop questions about the speed limit, the radar device, etc. Then he said he was done with the witness. To my amazement, he never asked the cop whether children were present, and the cop never mentioned it either. I had done my homework, and knew what this meant!I said “Move to dismiss for lack of a prima facie case.”“Move to dismiss WHAT?” asked the judge.“Move to dismiss the charges, for lack of a prima facie case.”“Mr XXX, do you have any other evidence to present?” the judge asked the DA.The DA drooped in his chair. “Uh, no sir.”“The motion will be granted,” said the judge. “The state has not presented a prima facie case that children were (a) present, and (b) near enough thereto to be endangered by traffic.” He signed a piece of paper and handed it to me. “Take this note to the clerk’s office and get your license back.”As I left the courtroom, the judge was chewing out the DA for not knowing how to argue a traffic case.I still think back fondly from time to time on my moment of legal triumph.
