PDF Editor FAQ

What is a "yellowtail tenure"?

It appears that you have been misled by a typographical error (on the NY Department of State's website - "yellowtail" indeed!).On the Rock Out Censorship Activism Central Bill of Rights of the New York State Constitution website [hey, I will accept help wherever I can find it], the term is "allodial tenures".According to Wikipedia's article on Allodial title:Allodial title constitutes ownership of real property (land, buildings and fixtures) that is independent of any superior landlord. Historically, allodial title was sometimes used to distinguish ownership of land without feudal duties from ownership by feudal tenure which restricted alienation and burdened land with the tenurial rights of a landholder's overlord or sovereign. Allodial title is related to the concept of land held "in allodium", or land ownership by occupancy and defense of the land. Historically, much of land was uninhabited and could therefore be held "in allodium"....Many state constitutions (Arkansas, Wisconsin, Minnesota, New York) refer to allodial title, but only to clearly distinguish it from feudal title. The conditions under which the government can compel the sale of privately owned real property for public necessity are established by eminent domain laws of either the federal or state governments, respectively. The Fifth Amendment to the United States Constitution requires just compensation for eminent domain compelled sale. In addition, the government powers of police power and escheat have been retained in the American legal system. This is pretty obscure stuff about which I previously had no knowledge. Thank you for your question.

Is it true that Allodial Title for your property means you don't need to pay property tax anymore?

Yes, in the traditional sense of the word, it does mean that, but if you live in a modern western nation, then true allodial title is almost certainly unavailable to you. In the U.S., only governments can hold land in allodial title, for example federal government owned parks and national forest land. There is no such thing as allodial title for land held by an individual, so beware anyone trying to sell you such a thing. There are people on the Internet trying to peddle this stuff, but it’s all snake oil.To confuse matters, apparently Texas and Nevada have used the term to describe landowner rights where unincorporated land has been annexed by a city or town. Their laws provide limited protection from falling under the taxing authority of annexing jurisdictions for existing owners, and this is sometimes referred to as limited allodial title, I guess because it evokes a right to escape that particular taxing authority. It sounds like an abuse of the term to me though, because true allodial title means the land is held subject to no one and nothing. “Limited allodial title” seems like an oxymoron to my way of thinking, but legislators don’t typically ask my opinion before writing laws.

Can I buy land from the government so that property taxes would not have to be paid anymore?

Not really. In Nevada there is a thing called “allodial title” wherein you prepay all of your estimated property taxes for the rest of your life. That’s not the same as a real allodial title, where you really do completely own the land without any obligation at all to the state, country, etc. When you die or sell the house, they get to tax it again.
