This time I plead guilty to the every thing I criticize others for- I admit I failed-I tried to put in visual aids, and make it as concise as possible. How we got to where we are today with mass incarceration is neither as simple or as straightforward as many progressives and former inmates believe.But here is the answer-My answer is California centered because that is what I saw happening both from in front of and behind the scenes.What are some of the main political forces that explain the United State's unprecedented reliance on mass imprisonment and other retributive policies?Well we had, prior to about 1830’s “Work Houses” for the poor, Debtors Prisons, and we had jails to temporarily house people pending a decision by the People’s Court. The idea of incarceration, as a rehabilitative tool, instead of a punishment, emerged in the 1830’s.We started down this path at the urging of progressive religious groups. In particular the Quakers. They thought that how criminal behavior was dealt with in society was cruel and completely unnecessary.Minor law violations were handled with-FloggingBranding- This carried the added bonus of providing a sort of rap sheet on one’s face.Then there was the ole, Tar and Feather Treatment. Often it included a splinter infested rail enhancement and a ride out of town.Now in the case of serious crimes, things actually got a lot simpler-You attended a meeting of the uplift society. There you were hoisted amid the cheers of the crowd.The Quakers basically insisted that “We could do better than that!”They asserted that it was far better to incarcerate the offender and let him/her do penance, meditate, read the bible, and let the word of God into their life. After that the inmate would be ready to return to society a new person, reformed, and ready to become a productive citizen.These places were called Penitentiaries, based on what they were built to do. Unfortunately the Quakers were only the first to assume that human beings exposed to reason and faith would change as a result.Laws were rewritten. Courtrooms built, Judges appointed, and Penitentiaries constructed. Corporal punishment and a lot of Capital punishment was abolished, in favor of this system designed to influence people to change their thinking.The concept of the prison as a place were thinking was “Corrected” took hold.Well time went by and it didn’t change much. In order to operate the “Penitentiary” with less expense, military style discipline, was imposed.Inmates were put to work in order to defray the cost of their confinement.Then they were contracted out-Heck, they were even used to replace the Guards!Mississippi’s Trustee shooters, manned the towers.Well this allowed wardens to run prisons with minimal tax dollars, and in some cases pocket some kick back money.Well back came the reformers. This time Hollywood provided a lot of help-I Am A Fugitive From A Chain Gang from I Am a Fugitive from a Chain Gang (1932)Again the cry was heard- “We can do better than this!”This time the idea that highly trained Correctional professionals, instead of a calendar would decide when an inmate had in fact been rehabilitated and was ready to return to society a changed person.The sentencing laws were changed again, and a panel of professionals selected to review inmates and place them outside on a conditional release. It was called “Parole.”In came the Indeterminate sentencing laws. Inmates in many places might get a 2 year to LIFE sentence. Every so often the inmate went before the Board and argue their case to be released.Then, in order to provide the inmate with essential marketable trade schools, the prison chain gangs were restricted. Welding shops, metal worker shops, sheet metal shops, and basic education for GED tests, were all provided at great expense to make the inmate ready to return to society. When “Changed” with the skills to make it upon return, and inmate was released back into society.We stopped calling them penitentiaries, or prisons, and started building new “Correctional” facilities. Duel Vocational Facility, Correctional Training Facility, Rehabilitation Centers, Medical facilities, Conservation Centers, even, my personal favorite, Men’s Colonies.By the 1970’s when I started, prisons were single celled (One inmate to a cell) and we had about 10% of our cells vacant. The plan was to close San Quentin, and reserve prison for only the most dangerous criminals.There were very few private prisons. It wasn’t profitable to house inmates one to a bunk or one to a cell.But I digress-Inmates learned how to navigate the system. Like the intelligent people many of them are they picked up how to get out early rather than late.We started paroling them to half way houses, outside their crime infested neighborhoods.Then in California it was decided that it would be far more effective (And BTW, a lot cheaper) if we put offenders on probation instead of sending them to prison. The state would pay the Counties about half the cost of a prison bed for a year to the Counties to supervise the offender on probation. There he/she could work, and go to whatever treatment program is necessary, while they supported themselves!!!I mean this looked sooooooo good.The only problem was, it still didn’t address the sad truth.Inmates only change because they want to-So the crime rate went up as more and more inmates were released sooner rather than later, and more and more inmates were kept on probation and never sent to prison.Then the media, and the public turned on the system.They started seeing stories in the media about some really sick dangerous people somehow, were released back into society to do some really sick cruel things to innocent victims-Here are just a few-Lawrence Singleton-Lawrence Singleton: From Released Prisoner to MurdererThis man was evil walking the earth. He was consuming oxygen for no good reason. He was released and it wasn’t long until he found a new victim. Mary Vincent was kidnapped, and then raped. He took an ax, and gave Mary Vincent a couple whacks.Left her for dead, naked, minus her arms, walking down the road.Larry was by no means alone. The outrages only increased. Between Larry, then another horrible monster, a prison escapee that wiped out a family, Kevin Cooper-and his 40 or so whacks-This set off the California cry repeated over and over again as he dedicated new prisons up and down the state-“If you commit a crime, we will, if we have to, build you a place to be locked up in.” Governor George Deukmejian.This guy here-Richard Allan Davis.His antics, on parole included kidnapping Polly Klass from her bedroom. The search and sad discovery of her remains erupted into the National news.The stories about this person began to appear on the nightly news, and in the papers. It turned out Davis had been convicted of a long list of increasingly violent crimes including some sexually motivated ones. With Plea deals he was released early and often.He raped, murdered, and then hid her body under some ply wood. Once he was apprehended, confessed, and told the police, where Polly’s remains were, he decided to plead not guilty and go to trial.Upon conviction he turned and flipped off everyone-Not only was he sick, he was quite arrogant. So much so Three strikes passed the voters that November overwhelmingly, and it became law.Suddenly places started being called prisons again. California in 1980 had 12 prisons running at under 100% capacity. By the mid 1990’s California was at 33 prisons PLUS a host of community correctional centers, and most places were running double celled at 200% + capacity.Gyms were converted into housing units-New prisons were built-YES, by 2000, or so the denunciation of mass incarceration returned.We can do better than this!!We need more drug treatment, more training for trades, Norwegian dorm rooms for inmates. YES, they shouted we need to stop incarcerating as many people!!So that is how we ended up with mass incarceration.
