CPC Order-19, Rule 3. Matters to which affidavits shall be confined(1) Affidavits shall be confined to such facts as the deponent is able of his own knowledge to prove, except on interlocutory applications, on which statements of his belief may be admitted; provided that the grounds thereof are stated.___________________________The CPC governs only those affidavits which are to be filed in courts.It says the personal knowledge of deponent is necessary.For Name change also the joint affidavit is not allowed, it deals with for individual purpose not Joint purpose.___________________________Whether the affidavit is required in court proceeding or otherwise.If it is not to be filed in civil proceedings then the provisions of CPC may not be applicable.It is required in your individual personal capacity/ purpose Joint affidavit is not permitted.Hence, I am of the opinion that joint affidavit, unless prohibited by Rules, can be filed provided that the affiants/ deponents have personal knowledge of the facts narrated therein and the purpose should be Joint purpose.

Been there, done that (for my wife).My wife’s passport had my short name not full name as on my passport. We decided to get it fixed before it creates any issue when we use it. So, my wife applied for spouse name correction and require following documents:Address proof of new address on name of my wife (applicant)My (husband’s) name change affidavit (from short name mentioned in my Wife’s passport to my full name which we wanted)Two Newspaper (One Telgu/regional lang, One English/National) cuttings announcing my (husband’s) name change as in Pt 2.Marriage certificate/Joint Affidavit with joint photos with Full corrected names (Here, both wife’s and husband’s name should be as you want on passport).My (husband’s) passport copyPassport document advisor did not mentioned all these documents. First time when she went with marriage certificate which contained her maiden name and my passport copy. She was sent back to get other documents (joint affidavit instead of marriage certificate with new names and other docs). Two days later she went again with other asked documents. Some of above documents might not be required now, please check passport website but in worst case taking extra documents to passport office doesn’t hurt but saves you multiple trips.Note: I couldn’t find Joint affidavit on Passport website so not sure if its still required. Else go once to PSK and if they find any doc missing then they will anyways ask you to get those in 2–3 days (appointment not required when called again).

The guideline is just a guideline. If there are additional circumstances known or suspected, a joint affidavit of support is something you might be asked for. You can say no, your case will be judged on its merits, and you might not immigrate. Or you can follow the recommendations of your consular officer, which are designed to keep your case as fast and clean as possible so you can immigrate with a minimum of trouble.
