A “living constitution”, in the sense of a constitution subject to reinterpretation, has no pros. The terms of the contract must be interpreted based on what those words, phrases, and clauses meant at the time it was ratified, not based on the whims of modern usage.If you sign a contract, you sign it based on what it meant then, not what it means when the other signatory decides in six months the contract means because his wife died, his dog left him, and his truck is cheating on him, and now he needs a few hundred thousand more to fix things. If they are still on a trial period you can let someone go without any particular reason. But this is only for the first month out of a fixed term employment contract with a minimum of six months. You can renew fixed term employment contracts 2 times, with a maximum of two years (total) of fixed term of employment. If you want to fire someone during that time, you will simply not renew their contract rather than actually firing them.After two year of fixed terms, an employee automatically will be in permanent employ. Then it becomes VERY difficult to fire someone. And an employee being disrespectful towards their employer usually is not a valid reason to fire someone. An employee actually has to give permission to be fired. If they don’t give permission, you as an employer you will have to ask permission from the court and/or labor office.You might fire someone on the spot only for some very serious offences. Such as violence, threats, dangerous behaviour, fraud or theft. But even then the rules are very tricky for the employer because Dutch law heavily favours the employee. In some cases even theft will not be grounds for summary dismissal and you will have to go through the courts to ask permission to fire someone. So firing someone just because they’ve been disrespectful is practically impossible.

They’re different and should be treated differently. But some resumes make them look the same.
