What are some major red flags to look for in a lease as a tenant?Anything you don’t understand. If it’s not written in such a way that the term/condition is very clear, then be wary.Check on who pays for repairs (our leases make the tenant responsible for up to $75, which is the call-out fee for the home warranty). But any glass breakage (window, mirror, etc) is solely the responsibility of the tenant. Truthfully, though, if the tenant calls and tells us something is broken/not working, we just go ahead and repair it at our expense. But we’re not like most landlords, so you can’t go by what we do in that case.Look for any “Additional Terms and Conditions”. These are usually added at the end of a pre-printed lease form. For instance, in ours, we make the tenant responsible for changing the HVAC filters at least every other month. We also include some of the easiest-to-violate HOA rules, such as making sure the trash cans are put away on the same day as trash pickup and not parking on the street.Make sure the lease includes exactly how much rent you are paying, what forms the landlord will accept (cash, check, money order, etc); exactly when it is due; is there a late fee and when does it start; and where the rent is to be paid. Any changes to any of those items MUST be in writing and agreed to by you both (except a change in where the rent must be paid - that can just be a written notice for an address change).Make sure the lease has contact information in it. Any changes to this must also be in writing.Make sure that EVERYONE (including children) who will be living in the unit is listed on the lease, either as a co-tenant or an “other occupant”. This is important because the landlord is leasing the unit to a specified number of people. If he comes back in 3 months and tries to say you have extra people there, you can simply point to page 5 of the lease and say “Nope - there’s his name right there”. Additionally, anyone who is living there must be listed on the lease in order to have proof of residency for things like the DMV.Read the lease carefully BEFORE you sign it. Don’t hesitate to ask the landlord for the lease a day or two before you sign, just so you have time to read it carefully.Also, be SURE you do a walk-through at the beginning of the lease, either with the landlord or his representative. Get a WRITTEN and SIGNED walk-through form. Be picky and make sure every little thing is listed, even if you’re assured it’ll be fixed “shortly”. And get a copy of that walk-through form! Even if you have to just take a picture with your phone. When it’s time to leave, you don’t want the landlord using your security deposit to pay for an item he was supposed to have fixed “shortly” but never got around to it.
