In state prison, is an inmate allowed to have a medical device such as a CPAP machine for sleep apnea?

Legally, yes. However there are several ways that staff and bureaucracy create barriers to providing this vital health care equipment to inmates. The first is bureaucratic barriers to access to MDs. Because a cpap machine requires a prescription, inmates must have access to their medical records or to the doctor who prescribed the cpap machine. Most inmates are unable to contact these medical providers once they are in custody. They do not have access to internet or phone books to look up MD contact information. If they happen to have the phone number, they can only make collect calls, which most MDs don’t accept. If they happen to have the address, they cannot simply request the records be sent to themselves. MD requires the patient to sign a release of information form to have records sent to themselves. So the MD must first mail the form, then the inmate sign and mail back, then there may be a charge for reproducing the records and mailing out which the inmate cannot pay themselves because they can’t send money through the mail, so someone on the outside would have to pay for them.If there is a social worker or nurse, they can have the inmate sign a release of info and more easily make the request for records, but the staffing levels are such that it’s unlikely to happen.If the prescription is expired or if the inmate has not been diagnosed yet, then the inmate first must request to see a doctor. The doctor then had to be willing to write a prescription for the inmate to have a sleep study. This requires either an overnight stay in a sleep lab or that medical test equipment be provided in the inmate’s cell or dorm. To see a doctor is difficult. To see a doctor willing to prescribe a sleep study for an inmate is even more unlikely. One of the barriers to this is many times the health care is contracted out to private companies which are incentivized to provide the least amount of care in order to maximize profit from the contract.The unfortunate aspect of systemic barriers to cpap equipment is that untreated sleep apnea increases the rates of a whole spectrum of impulsive, aggressive and cognitively impaired behaviors, creating an unsafe environment for staff, inmates and ultimately our communities.
