The parties are entitled to conduct discovery to obtain relevant information from the other side. The courts attempt to balance that right against the opposing party’s right to protect trade secrets. Methods include protective orders to limit or forbid disclosure of information, holding hearings in chambers (in the judge’s office with members of the public excluded), placing portions of the court’s file under seal where nobody can read it without a court order, and ordering any person involved in the suit not to disclose information without court approval.Whether such a lawsuit would be successful is an entirely different question.
