PDF Editor FAQ

If a greencard holder is deported from the u.s. for an aggravated felony and they remain out of the u.s. for 20+ consecutive years, can they ever return to the u.s. after like 25 years? What are the chances that they somehow in someway could return?

The bar on inadmissibility for an aggravated felony is permanent. It does not “time out” the way some other bars on admissibility does.A person who has been removed from the United States after a conviction for an aggravated felony can be readmitted as an immigrant only by either showing that the original conviction was in error, which normally requires a formal exoneration of the charges by the convicting court, or by obtaining an “extreme hardship” waiver. Extreme hardship waivers require the applicant to convincingly prove that failing to grant the waiver would cause “extreme hardship” to a relative who already resides in the United States. This waiver is extremely difficult to get, and has become essentially impossible under the present administration. In practice, the ban arising after deportation for an aggravated felony should be viewed as a permanent lifetime ban on immigration.Readmission as a nonimmigrant (temporary) visitor is subject to the rather more flexible rules for what are called Hranka waivers. Someone who was deported for a felony over twenty years in the past, and who has shown clear evidence of rehabilitation over that timeframe, likely has a fairly good chance of getting a Hranka waiver and thus being allowed to visit the United States, at least temporarily.

How do athletes from military academy schools play professionally and fulfill obligatory military service requirements concurrently?

They don't. The two most notable examples are David Robinson and Roger Staubach, both Naval Academy graduates. Both men served a two-year commitment in the Navy before applying for and receiving a Hardship Waiver to reduce their contractual obligation. Neither man played professional sports during the time they served. This isn't special treatment - any sailor can receive a hardship waiver if they've completed a certain amount of their commitment and can prove that remaining in the service would deprive them of a sizable opportunity or other life circumstances. Servicemen receive waivers for winning huge lottery jackpots, or a business taking off to huge profits, or their spouse leaving them with the children... any number of circumstances. The services aren't unreasonable, but you'd better have a really, really strong case, and that case is either that (in the case of Staubach or Robinson) the window is closing on your opportunity due to age, and/or that continuing to force you to honor your contract will be detrimental to the service due to your piss-poor attitude at being the only E-2 in the world worth $300 million.I'm sure there's a place to look up the exact regulation for hardship waivers. I don't feel like Googling it. But that's a pretty fair explanation.

Why do NCAA athletes have to sit out a year after transferring?

Actually they don't typically have to sit a year if you've never transferred from a four year school before, you are academically eligible and your old school does not object.Sitting a year is only mandatory when transferring within Division I if you play football, baseball, men's basketball, or women's basketball. If you play Division I FBS and transfer to FCS or a lower division you don't have to sit.In any sport if you complete a bachelor's degree and still have a season of eligibility left and haven't transferred between four year schools before without sitting a year you may transfer without sitting if your old school doesn't renew your scholarship or you are pursuing a course of study (another bachelor's degree or post-graduate degree) that your school does not offer.Regardless of sport you can transfer to a division offering less aid without sitting. You can go from I to II or III or from II to III or from FBS to FCS or II or from FCS to IIIn the four sports where sitting is mandatory within the Division the reason is the fear that that competitive pressure will lead to schools attempting to poach players. There is also concern that players will shift on a whim in those higher profile sports so sitting makes it a considered decision. For a time the NCAA permitted hardship waivers. For example a player in Arkansas signed with Texas. His child had a severe health issue and he was granted a hardship waiver but never played again because of the time demands. It was difficult to apply the rule consistently so the hardship waiver was eliminated and replaced with a procedure to apply for an extra year of eligibility. Players normally have 5 years to complete four seasons of competition. If a player transfers and can demonstrate a hardship for the transfer the player is granted six years to complete four years of competition. For younger players one strategy they employ is to leave their four year schools and go to a two year school during the year they were to sit and compete there, earn an associates degree and then transfer to a four year school.
