It is not some of kind of permanent social institution. There is no office. The militia are the citizens themselves.Historically, when authorized to do so, a sheriff would send word by his deputies to notify people in the community that they should retrieve their arms and muster at some location (typically to enforce the order of a local or county court). Or, by the governor, if the conditions were of a state character, though that was historically less frequent.For example, a property owner refuses to pay taxes to the county for years. The property is foreclosed on. The court orders the former owner to leave. The former owner refuses. He creates some conflict and threatens the sheriff. The sheriff might call up 100 men to remove the disagreeable litigant, and then they would go to the property and compel him to vacate the property—preferably peaceably, but not necessarily so.Today, states often regulate by state law their organized and unorganized militias. Each state's laws on the issue tend to be rather different. You have to go look specifically at what each state provides.But as to protecting your property generally, it is not unlawful to do so.
